Yes, some Hershey products can be called milk chocolate; the claim that Hershey cannot legally call its products milk chocolate is too broad. U.S. rules set standards for milk chocolate and specify a different name for a product made with a vegetable-fat coating. Hershey says its classic year-round milk chocolate bar and Reese’s Peanut Butter Cups are not changing, while a small portion of other offerings is planned to move to classic recipes beginning in 2027. The dispute concerns particular products and allegations about ingredient changes—not every Hershey product or a proven company-wide cost-cutting motive.
What the milk chocolate rules actually require
The FDA describes standards of identity as rules defining what a standardized food must contain; milk chocolate is one such food. The agency’s overview is available in its Standards of Identity for Food page.
The specific regulation, 21 CFR § 163.155, covers “milk chocolate and vegetable fat coating.” It provides for the name “milk chocolate and vegetable fat coating,” or an appropriate name specifying the vegetable fat used in the coating. In other words, the regulation addresses how a product in this category is named; a product with a vegetable-fat coating is not simply named “milk chocolate” under that provision.
The Associated Press summarized the U.S. FDA requirements as including at least 10% chocolate liquor, 12% milk solids and 3.39% milk fat. These figures are AP’s February 2026 summary of the requirements. Chocolate liquor is a paste made from ground cocoa beans; despite its name, it contains no alcohol.

Why some packages say “chocolate candy”
A package’s wording can reflect the recipe and product category, but it does not by itself establish why a company chose that recipe. AP reported in February 2026 that some seasonal Reese’s Hearts packaging used the phrases “chocolate candy” and “peanut butter crème.” That example concerns a particular seasonal product, not all Reese’s cups or Hershey bars.
To assess a product, compare the exact package version and product name, its ingredient list, and whether it identifies a vegetable-fat or other coating. A label phrase is evidence about that product’s description; it is not proof that every product from the brand has the same ingredients or legal status.

What Hershey says is changing—and what is not
Hershey’s “Our Ingredients” page, last reviewed September 29, 2026, says the classic Hershey’s Milk Chocolate bar and classic Reese’s recipes are not changing. The company says a small portion of limited-edition, seasonal and other offerings that do not match the classic recipes will be brought in line with those recipes beginning in 2027. It says core year-round Hershey’s and Reese’s products are excluded. See the company’s current statement at Our Ingredients.
That current company statement is consistent with Hershey’s position, reported by AP in February 2026, that classic Reese’s Peanut Butter Cups continue to use milk chocolate and peanut butter. AP also reported Brad Reese’s accusation that some Reese’s products had shifted to cheaper ingredients. Hershey said it makes recipe adjustments for innovation and consumer demand. The cost-cutting characterization is an allegation attributed to Brad Reese, not an established explanation for every product or change.

How to check the product in your hand
- Identify the exact item. Note whether it is a year-round product, a seasonal item, a limited edition or another variation; do not assume the recipe or label for one applies to the rest of the brand.
- Read the package name and ingredient list. Look for the precise wording used on the package and any stated coating. Use the package itself as the reference for the item you bought.
- Use product-specific information carefully. Hershey SmartLabel’s page for a HERSHEY’S Milk Chocolate six-bar pack says a page opened without scanning the package QR code may show a previous product version.
