The claim that the Federal Trade Commission now has three Republicans and no Democrats is not confirmed by the official roster material available as of October 8, 2026. The FTC’s commissioner page names Chairman Andrew N. Ferguson and Commissioner Mark R. Meador, but that material alone does not establish that the agency has only two serving members—or confirm a three-Republican roster.

What the official roster material confirms

The FTC’s official commissioner page lists Andrew N. Ferguson as chairman and Mark R. Meador as commissioner. The page material available as of October 8, 2026 names those two serving commissioners; it does not verify the claimed total of three Republicans, and it should not be treated as proof that no other commissioner is serving.

The FTC’s biography for Melissa Holyoak says her service as a commissioner ended on November 17, 2025. The Department of Justice later announced that she was sworn in as U.S. Attorney for Utah on May 28, 2026. How many commissioners may the FTC have?

The FTC is designed to have five commissioners, each serving a seven-year term. The president nominates commissioners, and the Senate confirms them. The agency’s official description also says that no more than three commissioners may belong to the same political party. FTC: Commissioners

That three-member ceiling is a limit, not a required balance. It does not require all five seats to be occupied, guarantee that both parties have commissioners, or mandate a 3–2 split. A vacancy or an unverified roster count should therefore not be mistaken for a change to the governing rule.

Is a 3–2 split the FTC’s typical arrangement?

The official material confirms at least one 3–2 configuration, but it does not establish how often that balance has occurred. In a March 14, 2011 speech, then-commissioner William E. Kovacic described the commission at that time as having “3 Democrats and 2 Republicans.” That is evidence of a historical example, not proof that 3–2 was the usual arrangement across the FTC’s history. What to take from the claim

  • Legal design: five seats, seven-year terms, presidential nominations and Senate confirmation, with no more than three commissioners from one party.
  • Current roster: the official page material available for this article names Ferguson and Meador; the claim of three Republicans and no Democrats is not verified by that listing.
  • Historical balance: a 2011 speech documents one 3–2 commission, but does not show that 3–2 was historically typical.
