Prosecutors estimate that about $152,000 was taken from the company’s matching-gift program and that roughly $100,000 in charitable contributions was overreported as tax deductions. Those are allegations in a charging announcement, not court findings.
What prosecutors say happened
According to the District Attorney’s Office, the alleged conduct ran from July 1, 2018, through April 6, 2021. Prosecutors say five employees used the third-party platform Benevity to report donations to the American Chinese International Cultural Exchange (ACICE) or Hop4Kids. Apple’s program then matched employee donations at 100% or 200%, and Benevity distributed the funds to the charities.
Prosecutors allege that Siu Kei (Alex) Kwan, whom the release identifies as Hop4Kids’ CEO and ACICE’s accountant, reimbursed the employees for their donations while retaining Apple’s matching funds. The release further alleges that employees claimed the reimbursed donations as tax deductions, and that Kwan prepared tax returns and offered free or discounted tax services to encourage participation. Who was charged and what charges were announced
The District Attorney’s Office named six defendants: Siu Kei (Alex) Kwan, Yathei (Hayson) Yuen, Yat C (Sunny) Ng, Wentao (Victor) Li, Lichao Ni, and Zheng Chang. The release listed alleged felony offenses including grand theft, conspiracy to commit felony grand theft, perjury, and tax fraud, as well as an aggravated white-collar crime enhancement.
The office said arrest warrants had been issued and arraignment dates would follow. It also said that, if convicted, defendants could face jail, restitution, and fines and fees. Santa Clara County District Attorney Jeff Rosen said in the December 3, 2024 release: “This case underscores our unwavering commitment to rigorously prosecuting individuals who defraud the tech community and misuse vital charitable programs and state resources. We commend Apple for coming forward and actively collaborating with our Office to uncover this elaborate fraud. We encourage others in the tech community to do the same. It’s the holidays. Give – legally – to help the needy, not to help yourself.” This is the prosecutor’s characterization of the case, not an independent court determination.
