Usually, yes—but there is no single U.S. commercial fishing license that covers every operation. You may need authorization from a state or territorial agency, one or more federal permits, or both. The exact requirements depend on where you fish, the species and gear involved, and whether you harvest, land, or sell the catch.
Why commercial fishing permits vary
Commercial fishing is governed by overlapping jurisdictions and fishery-specific rules. NOAA Fisheries says commercial fishermen operating in state waters must follow the state or U.S. territory’s requirements. Federal requirements vary by area, species, and gear; a vessel may need multiple federal permits or a combination of federal and state permits. In fisheries managed under both systems, federally permitted fishermen must follow the more restrictive rules regardless of where they operate. NOAA’s commercial fishing resources provide an overview, not a permit determination for a particular operation.

There is no single nationwide boundary or credential that resolves every case. Start with the agencies responsible for the specific fishing area and fishery.
Which permits or licenses might you need?
State or territorial authorization
Contact the fish and wildlife or marine fisheries agency for the state or territory connected to your operation. Ask about the commercial fishing license, species-specific permits, vessel registration, landing documentation, and any dealer or sales authorization that may apply. Rules can differ even between nearby jurisdictions.

Federal permits
For a federally managed fishery, use the relevant NOAA Fisheries regional resources to identify permits for the target species and gear. NOAA’s Permits and Forms directory links to regional applications, reporting forms, permit-holder information, and online systems. It does not mean every federal permit is handled through one portal.
Harvesting permission may not cover selling
A permit authorizing harvest does not necessarily authorize every step involved in landing or selling the catch. NOAA’s Atlantic highly migratory species (HMS) guide says a federal commercial HMS permit holder may also need a state permit to sell HMS. Check sale and dealer rules with the agencies for the particular fishery and destination.

What the rules look like in specific fisheries
California: license, vessel registration, and fish tickets
California illustrates how several requirements can apply to one operation. The California Department of Fish and Wildlife says an applicant must have a valid commercial fishing license before receiving a non-restrictive commercial fishing permit. It also requires commercial boat registration for resident or nonresident owners or operators of vessels used in qualifying for-profit fishing operations in the state’s public waters. Some limited-entry or restricted-access permits are reserved for pre-qualified commercial fishermen or vessel owners.
California requires fish caught under commercial license authority—including fish kept for personal use—to be landed and documented on an electronic fish ticket submitted through E-Tix. First-time license purchasers and vessel registrants must contact the department to establish a customer account. These are California-specific requirements, not national rules. Atlantic highly migratory species: limited access and training
NOAA’s HMS Commercial Fishing Compliance Guide, dated September 30, 2025, says commercial permits for highly migratory species depend on the target species and gear. For specified limited-access categories—including certain swordfish and shark permits and the Atlantic Tunas Longline category—NOAA says it is not issuing new permits. A new entrant must obtain a permit by transfer from a permit holder leaving the fishery, subject to vessel-upgrade restrictions. Those permits must be renewed annually. The guide also specifies a safe-handling, release, and identification workshop certificate for certain swordfish or shark limited-access permit applications. Check the current guide and permit information before relying on these fishery-specific rules.
How to identify the requirements for your operation
- Map the operation. Identify where the vessel will fish and where the catch will be landed or sold. Determine which state, territory, or federal fishery rules may apply.
- Specify the fishery. Write down target species, gear, vessel, and whether the activity includes harvesting, landing, or selling. These details affect which credentials and reporting duties to check.
- Contact the relevant agencies. Use NOAA’s regional commercial fishing resources and permit directory for federal fisheries, and ask the applicable state or territorial agency about its requirements.
- Check availability and conditions. Confirm whether a permit is open to new applicants, limited access, transferable, tied to a vessel or holder, or subject to training, renewal, or reporting requirements.
- Verify current application details. Confirm fees, deadlines, forms, renewal dates, and reporting procedures directly with the agency. Keep the issued permits and agency instructions with the appropriate vessel or operator records.
Do not treat a recreational fishing license as proof that commercial harvest or sale is authorized.

What to compare before applying
When several credentials may apply, compare each one on the terms that determine what it actually authorizes:
- Issuing agency and jurisdiction
- Covered species, fishing area, and permitted gear
- Named permit holder and vessel, if applicable
- Whether it covers harvest, landing, or sale
- Whether entry is limited or transfer is required
- Training prerequisites, renewal period, and reporting duties
- Current application method, fees, and deadlines
These details matter because a permit for one species, area, gear type, or activity may not cover another, and a restricted permit may not be available to a new applicant.

Where to confirm current requirements
Use the relevant agency’s current instructions before fishing or selling catch. NOAA’s Permit Information list is an online resource, but it is not exhaustive of all regional permits. For state requirements, consult the responsible state or territorial agency; for example, California publishes its commercial license and permit information through its Commercial Fishing Licenses page.
