Re:

Over 50 and Just Laid Off From Big Tech? What to Do Next

Protect your cash, coverage, legal rights, and retirement choices after a Big Tech layoff over 50—then build a realistic path to another role, consulting, bridge work, or retirement.

After a Big Tech layoff, protect your cash, benefits, records, and legal rights before making an irreversible decision. In the first week, get clear on the separation package, health coverage, unemployment, and financial runway. Then decide whether to pursue another full-time role, consulting, a bridge job, or retirement. A layoff at 50 or older is not, by itself, a reason to retire or proof that you cannot find work.

Your first 24 hours: preserve information and avoid rushed decisions

Access to company systems can disappear quickly. Save personal employment and benefits records where lawful and permitted, and write down what happened while the details are fresh.

  • Keep your layoff notice, severance agreement, separation policy, recent pay stubs, compensation statements, and benefits information.
  • Save your equity-award agreements and vesting schedules, bonus or commission terms, and 401(k), pension, and deferred-compensation documents.
  • Keep relevant performance reviews, awards, and your own notes on projects, measurable outcomes, technologies, and leadership responsibilities.
  • Collect contact information for colleagues who may be willing to serve as references.
  • Note the date, people present, and exact words used in the layoff meeting, especially if comments about age, retirement, or “culture fit” were made.
  • Confirm your final paycheck date and the date your employer health coverage ends.

Do not copy proprietary code, customer data, confidential road maps, trade secrets, or other company material you are not authorized to keep. Do not sign a separation agreement on the spot. Note its deadline and make time to review the terms.

Review the severance agreement before accepting it

Severance is more than a number of weeks of pay. Read the agreement and any separate policy for provisions that affect claims, cash flow, future work, and benefits:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Release of claims: What claims are you being asked to waive, and what rights or claims are excluded?
  • Pay and benefits: How much will you receive, when will it be paid, and does the package include employer-paid COBRA, outplacement, or other support?
  • Equity and incentive pay: What happens to unvested awards, vested options, bonuses, and commissions? Are there deadlines to exercise options?
  • Restrictions and obligations: Review confidentiality, nondisparagement, cooperation, noncompete, and nonsolicit language, as well as property-return and file-deletion requirements.
  • References and communications: Check whether the agreement specifies a reference response or controls how the departure may be described publicly.
  • Acceptance deadline: Identify the date by which you must sign and whether the agreement describes any review or revocation period.

For an employee aged 40 or older, a waiver of federal age-discrimination claims generally must satisfy additional requirements under the Older Workers Benefit Protection Act. In some group layoffs, employers must provide information about the ages and job titles of selected and nonselected employees. The details matter; a release is not automatically unlawful, and enforceability depends on the document, circumstances, and applicable law. Ask an employment lawyer to review a consequential agreement before its deadline. See the EEOC guidance on severance waivers.

If you negotiate, possible requests include more salary continuation, a later separation date, a pro rata bonus, employer-paid COBRA or an insurance stipend, an extended option-exercise period, outplacement, or agreed reference language. There is no guarantee the employer will negotiate. Legal advice is particularly valuable if there are unpaid incentives, a broad release, restrictive covenants, a protected-leave issue, or facts that raise a discrimination or retaliation concern.

Secure health coverage before your current plan ends

Compare coverage based on your doctors, prescriptions, dependents, total cost, and enrollment deadlines—not just the monthly premium.

Option What to check Trade-off
COBRA Read the election notice for your deadline, premium, and plan details. Eligible workers generally have 60 days from the later of the notice date or the date coverage ends to elect. Coverage generally lasts up to 18 months. Can preserve the existing plan and network, but you may have to pay the full group premium plus a 2% administrative fee. Actual cost comes from the plan notice.
ACA Marketplace Losing job-based coverage usually creates a Special Enrollment Period. Check available plans, provider networks, drug formularies, deductibles, and estimated household income for the coverage year. Premium tax credits may make a plan less expensive, but cost and eligibility depend on household circumstances; a lower premium may come with a different network or out-of-pocket costs.
Spouse’s employer plan Ask the spouse’s plan administrator about its special-enrollment process and deadline after loss of other coverage. May provide a practical alternative, but compare the added premium and plan coverage with other options.
Medicaid Check your state’s eligibility rules and household income calculation. Eligibility varies by state and income; a high severance payment may affect when you qualify.
Medicare If you are approaching 65, coordinate enrollment with Medicare, employer coverage, COBRA, Marketplace coverage, and any severance-funded insurance. Medicare is generally relevant at 65, not at 50 or 55. COBRA is not always treated like current-employer coverage for delaying Medicare enrollment, so verify your situation before waiting.

The Department of Labor explains COBRA and health coverage after job loss. For Marketplace coverage, use HealthCare.gov’s guidance for unemployed people. In 2026, HealthCare.gov says a job-based plan is considered affordable under applicable rules when the employee share of the lowest-cost plan is less than 9.96% of household income; this is an affordability test, not a prediction of Marketplace premiums. Update your Marketplace income estimate if severance, unemployment, consulting, or a new job changes household income.

If you are nearing 65, the Social Security Administration warns that people not receiving Social Security may need to apply for Medicare when they turn 65; delaying Part B can lead to a penalty in many circumstances. Review Social Security and Medicare coordination and get advice for your specific coverage history.

File for unemployment and report income accurately

Unemployment insurance is administered by states, which set eligibility and filing rules. If you may qualify, file promptly with the state where you worked—usually as soon as employment ends—and follow its instructions.

  1. Gather your employment and wage information, separation date, and any requested details about severance or other payments.
  2. Report severance, paid notice, consulting work, and other income accurately as the state directs.
  3. Complete required weekly or biweekly certifications and keep a record of job-search activity.
  4. Respond promptly to agency requests and appeal a denial if you believe the facts or state rules support an appeal.

Claims generally require employment and wage information. The Department of Labor gives two to three weeks as a general estimate for first payment timing, not a guarantee; see its unemployment insurance overview. Do not assume severance delays or disqualifies benefits: the outcome may depend on how a state classifies the payment and when it is paid. Garden leave, a retention payment, consulting income, availability for suitable work, or refusing an offer can also affect eligibility under state rules. The Department of Labor links to state workforce agencies at its location directory.

Calculate your financial runway before changing your long-term plan

Start with cash available for living expenses, not total net worth. A simple estimate is:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Liquid funds available for living expenses ÷ monthly essential spending = approximate months of runway.

Make the estimate useful by separating essentials from expenses you can adjust and from discretionary spending. Include debt payments, medical costs, taxes on severance or withdrawals, family obligations, expected unemployment benefits, and realistic consulting income. Do not count a hoped-for job offer as cash.

Scenario Planning assumption
Optimistic A new job arrives within a few months at a similar level.
Base case The search takes longer and the next role pays less.
Stress case You go 12 months or longer without comparable employment.

Use the scenarios to decide how much spending to pause and when to widen your job search. A temporary hold on major purchases, large gifts, renovations, or speculative investments may preserve choices while facts become clearer. Avoid turning a short-term shock into a permanent retirement or investment decision before you understand benefits, taxes, and likely income.

Severance is generally taxable income, but withholding and final tax liability depend on payment structure, state, household income, and other factors. A lump sum can leave you under-withheld even when payroll has withheld tax. Ask a tax professional whether estimated payments are appropriate.

Protect retirement accounts, equity, and incentive pay

401(k), pension, and deferred compensation

Do not cash out or roll over a 401(k) automatically. Compare leaving the account in the former employer’s plan, moving it to a new employer’s plan, rolling it into an IRA, or taking a distribution. Review the plan’s Summary Plan Description for fees, vesting, distribution options, and procedures; the plan document governs many practical details. The Department of Labor provides retirement-plan and ERISA information.

A tax rule sometimes called the age-55 separation exception may allow certain distributions from the employer plan after separation from service during or after the year you turn 55 to avoid the 10% early-distribution penalty. It generally concerns the plan of the employer you left, does not automatically apply to IRAs, and does not eliminate ordinary income tax. A rollover may change access to this exception. Before rolling over or withdrawing, confirm the details with the plan administrator and a tax professional.

For a pension or deferred-compensation plan, check vesting, payment choices, and timing. Ask whether a bonus requires active employment on its payment date, whether a commission is already earned, and whether the plan has a layoff, change-in-control, or other applicable provision.

RSUs, stock options, and company shares

Use the award agreement and company plan documents to establish what happens at termination. Make a list of what has vested, what may be forfeited, whether vesting accelerates, how long you have to exercise options, when shares can be sold, and whether trading or insider rules still apply. Check tax withholding and any blackout restrictions. “Vested” does not always mean immediately liquid, and treatment of unvested awards depends on the plan.

Do not treat Social Security as an automatic layoff benefit

Eligible workers can generally start retirement benefits at 62, but claiming before full retirement age means a lower monthly benefit than waiting until full retirement age. Benefits are based in part on the highest 35 years of earnings, so stopping work early can leave lower-earning or zero-earning years in the calculation. Delaying after full retirement age can increase the monthly benefit until age 70. The Social Security Administration explains the effects of stopping work in its retirement planner.

Consider cash needs, health and longevity expectations, spousal and survivor benefits, other income, taxes, investments, and the chance of returning to work. Get personalized estimates through your Social Security account; if the decision is consequential, discuss it with a fiduciary financial planner or benefits specialist. Social Security is an income-planning decision, not simply an emergency fund.

Search for work by showing what your experience delivers

Make recent, relevant results easy to see

Lead with problems solved and outcomes: revenue gained, costs reduced, reliability improved, migrations completed, teams developed, or work delivered in regulated or safety-critical environments. Show how you work across engineering, product, sales, legal, finance, and executives. Experience from a large company can transfer, but employers may discount work tied only to proprietary systems or a narrow corporate setting; explain the business problem and skills in terms another employer can understand.

A resume can emphasize the most relevant 10 to 15 years and move earlier roles into a concise additional-experience section. This prioritizes relevance, not a false record. Answer accurately when an application requests complete employment history. Keep the professional profile current, show recent tools and learning you can genuinely use, and add a concrete recent project or outcome where possible.

Do not change dates, misstate credentials or expertise, or pretend to be junior. Avoid unnecessary personal details such as age, graduation year, or family information unless a legitimate process requires them.

Target more than another giant technology company

Potential employers and work settings include mid-sized software firms, cloud and cybersecurity vendors, enterprise IT teams, healthcare, finance, energy, manufacturing, government contractors, professional services, and companies that need experienced operators. Former customers, partners, vendors, and portfolio companies may know where your domain expertise fits. Other possibilities include technical training, governance, compliance, implementation, and fractional leadership.

Run two search tracks

Track What it means Trade-off
Comparable role Similar function, seniority, and compensation. Preserves the former career direction but may take longer to secure.
Bridge role Contract or fractional work, a smaller firm, an adjacent industry, a hands-on role, or a lower-paid position with meaningful responsibility. May reduce pay or title, but can support benefits, reduce withdrawals, and buy time.

This is not a choice between recreating your old job and retiring immediately. Compare total household stability, including benefits and runway, rather than treating a lower salary or title as personal failure.

Use a focused network and prepare for likely questions

Start with former colleagues, managers, direct reports, customers, and trusted partners. Ask for conversations about teams, problems, and hiring plans rather than asking every contact for a job. Seek a referral when there is a clear fit. A useful weekly routine can combine targeted outreach, relevant industry events, and sharing practical technical or operating insights.

In interviews, be ready to address compensation expectations, role fit, adaptability, technical recency, management style, reporting to a younger leader, travel, and why you want this position. Use evidence: a recent system or tool you learned, a major change you adapted to, your reasons for choosing the role, and your comfort with its reporting structure. Be clear about the compensation range you are targeting.

Document possible age discrimination and get advice promptly

The federal Age Discrimination in Employment Act protects applicants and employees aged 40 or older from age discrimination in hiring, firing, layoffs, pay, benefits, training, and other employment terms at covered employers. It does not make every layoff involving older workers unlawful. A reduction in force may lawfully have a disproportionate effect on older workers if the selection method is based on a reasonable factor other than age. The EEOC also notes that an employer may favor older workers over younger workers, even when both groups are over 40. See the EEOC’s age-discrimination guidance.

Possible warning signs include pressure to retire, age-related comments, older workers being denied training or visible assignments, younger workers retained in similar roles despite comparable performance, replacement by substantially younger workers, or different treatment in rehire decisions. These facts may have explanations; record what happened rather than deciding by yourself that it proves a violation.

  • Keep dates, exact words, names of witnesses, written notices, and relevant emails.
  • Record your role, performance history, selection criteria if known, and comparable roles or employees involved.
  • Save any group-layoff information provided with a waiver and note what information was absent.
  • Talk promptly with an employment attorney, the EEOC, or your state civil-rights agency.

The EEOC says a charge generally must be filed within 180 days, though state law may extend the period in some jurisdictions; federal employees have different procedures and deadlines. Do not wait for a severance deadline to pass before getting legal advice, and do not reject severance solely to preserve a possible claim without advice on how the release, payment, deadline, and filing rights interact.

Choose a next step that fits your finances and preferences

Another full-time role

This may be the right path if you want to keep working, need predictable income or employer benefits, and can pursue comparable or adjacent roles. Set a review date to assess whether the target level, industry, geography, compensation, or work arrangement should change based on actual market feedback.

Consulting or fractional work

Consulting can fit someone with specialized expertise, a network that can generate leads, and enough runway to handle variable revenue. It also requires finding clients, negotiating contracts, invoicing, arranging insurance, and managing taxes. It may be a poor fit if you need immediate predictable income, have no pipeline, or face restrictions in the separation agreement.

A bridge job

A contract assignment, smaller-company role, technical account position, implementation job, training role, government or regulated-industry job, or part-time work can preserve income and potentially benefits while you reassess. Evaluate the full package and household effect, not only title or salary.

Retirement

Retirement can be reasonable if reliable income and assets cover essential spending, health coverage is solved, debt is manageable, and the household has stress-tested market and longevity risk. A durable plan should account for taxes, inflation, long-term care, and survivor needs. Also ask whether retirement is what you genuinely want, rather than a decision made to escape the shock of a layoff.

A practical plan for the first 90 days

Days 1–7: stabilize

  • Preserve lawful personal records, review the severance deadline, and write down layoff details.
  • Confirm final pay and coverage end dates; compare COBRA, Marketplace, spouse coverage, and Medicaid.
  • File for unemployment if eligible and calendar required certifications.
  • Inventory equity, bonus, deferred-compensation, pension, and retirement-plan deadlines.
  • Estimate monthly runway and pause spending that can wait.
  • Seek legal or tax advice where the agreement, equity, or payment warrants it.

Days 8–30: define the search

  • Write a one-paragraph statement of the problems you solve, your strongest evidence, and the roles you want.
  • Update your resume and professional profile to foreground relevant results and current skills.
  • Contact trusted people in your network and identify comparable-role and bridge-role targets.
  • Schedule a focused refresh in a relevant technical or domain area, ideally tied to a demonstrable project or work example.
  • Check spending and income assumptions against the three runway scenarios.

Days 31–60: test the market

  • Track targeted conversations, applications, interviews, and responses to your positioning.
  • Test whether consulting, fractional work, or a bridge role has real prospects rather than relying on an unconfirmed pipeline.
  • Adjust your pitch based on repeated employer concerns or gaps in the roles you are seeing.

Days 61–90: make a deliberate adjustment

  • Decide whether to widen industry, geography, title, compensation, or work arrangement based on evidence from your search.
  • Reassess retirement feasibility if you are drawing down savings or your preferences have changed.
  • Get another financial review if withdrawals, health costs, or tax decisions are materially changing the plan.
  • Stop prioritizing role types that repeatedly show little traction and redirect effort to more plausible options.

Free resources and professional help

Start with official and publicly funded resources where they can answer the immediate question. CareerOneStop and the Department of Labor’s American Job Center directory can help locate career and workforce services; local eligibility and programs vary. For Marketplace coverage, begin at HealthCare.gov. For age-discrimination questions, contact the EEOC or a state agency, and get a lawyer’s advice on a release or possible claim. For significant severance, equity, rollover, or Social Security decisions, consider a qualified tax professional or fiduciary financial planner and verify fees, credentials, and conflicts before hiring anyone.

Paid career coaching or outplacement may be useful if your employer provides it or if you need structured support. Compare it with free workforce services and targeted help from trusted professionals; no service can guarantee a job. Training can help demonstrate current knowledge when it leads to a relevant project or credible work example, but a certificate alone does not establish experience.
