The date depends on the property’s state, the lease’s term and renewal language, the kind of tenancy, and the state’s notice and service rules. Start with the lease and the state where the land is located; do not assume a calendar-year deadline applies.
What determines a farmland lease termination deadline?
First identify the state whose law applies to the farmland lease. Then read the agreement’s term, renewal, termination, and notice provisions. A lease may set a deadline or a renewal process that affects when notice is due; statutory default rules also vary by state and may apply differently to fixed-term leases, year-to-year tenancies, and oral agreements.
Next, establish the relevant lease end date or lease-year end. A notice period may be measured from that date rather than December 31 or the anniversary of signing. Finally, verify whether notice must be written, how it must be delivered, and whether it must be received by the deadline. The number of days alone does not establish that notice was properly given.
How to work out the date before sending notice
- Locate the property and governing agreement. Record the state, the parties, and whether the agreement is written or oral.
- Find the term and renewal language. Identify the expiration date, any lease-year convention, automatic-renewal language, and any clause setting a notice date or method.
- Classify the tenancy. Determine whether the rule you are checking covers this arrangement—for example, a fixed-term lease or a periodic year-to-year tenancy.
- Check the current state rule. Confirm the applicable notice period, when that period is measured from, and any requirement about writing, service, or receipt.
- Document delivery. Use a method permitted by the lease and applicable law, and keep a copy of the notice and evidence of delivery or receipt.
If the lease language and a statutory default seem to point to different dates, or a renewal deadline is close, confirm the applicable rule with a current state authority or local counsel before relying on a calculation.
How state rules differ: examples, not a national deadline table
These examples illustrate why the lease type and jurisdiction matter. They are not a complete survey of U.S. law, and they do not establish a deadline for a lease in another state.

Why the lease-year end and service method matter
A deadline is calculated from the date named by the applicable lease or law. Depending on the arrangement, that may be the lease’s expiration date or the end of its year of letting—not the end of the calendar year. Before counting backward from any date, verify that it is the correct reference date for this tenancy.

Also check the notice clause and applicable service rules. Confirm whether the notice must be written, what it must say, which delivery methods are permitted, and whether it must be sent or received by the deadline. Preserve the notice and delivery records. If the agreement is oral or the applicable rule is unclear, do not assume that an informal conversation is sufficient.

Act promptly. In some jurisdictions, missing a notice deadline can result in renewal or continuation of the tenancy; Delaware’s statute provides a year-to-year renewal consequence for covered arrangements when notice is not given. Do not assume the same consequence applies elsewhere. Review the agreement and current state rule, then seek local legal advice if the notice date is near or has passed.
