Solos sues Meta, Oakley and EssilorLuxottica over smart-glasses patents

Solos’ 2026 lawsuit accuses Meta and eyewear partners of infringing five patents in Ray-Ban Meta and Oakley Meta glasses. The claims remain unresolved, and a separate PTAB challenge targets one patent.

Solos Technology Limited filed a patent-infringement lawsuit on January 23, 2026, against Meta Platforms and four eyewear-related companies, alleging that Ray-Ban Meta and Oakley Meta smart glasses use technology covered by five Solos patents. The case remains a dispute over allegations, not a court finding that any defendant infringed. As of August 18, 2026, the available docket summaries list the case as open.

The complaint and case details are available through the complaint PDF and the district-court docket listing. Solos says the Massachusetts court is an appropriate venue in part because Meta has operations in Cambridge where technologies in the accused products were allegedly researched or developed. That is Solos’ jurisdiction and venue argument, not a finding about infringement.

What Solos alleges the glasses do

The five patents concern technology that Solos characterizes as relevant to smart eyewear, including multi-microphone audio capture and processing, beamforming and noise reduction, directional or open-ear audio, acoustic structures within eyeglass frames, and systems that combine sensor information to provide context-aware assistance.

In practical terms, the complaint’s theories concern how glasses can capture and process a wearer’s voice and surrounding sound, deliver audio without conventional headphones, and use sensor inputs or companion-device data to assess context and provide feedback. The patent claims are specific legal definitions, however: the presence of microphones, speakers, or sensors in a product does not by itself establish that the product practices a patent claim.

Solos attached claim charts for each asserted patent. Its complaint uses the Ray-Ban Meta Wayfarer Gen 1 as a representative product for its charting and alleges that later models use substantially similar relevant architectures. Those are Solos’ infringement theories; the court has not determined whether the products meet the claims.

Which products are accused?

The complaint identifies product families and reaches variants, updates, derivatives, and successor products that Solos says use substantially similar implementations. Its listed products include:

  • Meta Ray-Ban Stories.
  • Ray-Ban Meta Wayfarer Gen 1 and Gen 2.
  • Ray-Ban Meta Skyler Gen 2 and Headliner Gen 2.
  • Ray-Ban Meta Display.
  • Oakley Meta HSTN.

The breadth of the complaint does not mean every model has identical internal hardware or software, or that every asserted patent is alleged to cover every feature in every listed product. Hardware revisions, software updates, regional versions, and later generations may differ. The complaint and accompanying materials set out Solos’ product allegations.

Why Solos says the infringement was willful

Solos alleges that the defendants had prior awareness of its work through product demonstrations, industry meetings, patents, studies, and interactions involving company personnel. It further alleges that Meta personnel studied Solos products and patents and that EssilorLuxottica personnel had tested or encountered Solos technology. The complaint is the source of these assertions; their inclusion does not independently establish what any defendant knew, when it knew it, or whether infringement occurred.

The complaint seeks enhanced damages on a willfulness theory, but such damages are not automatic. A court would have to consider the evidence and applicable legal standards before awarding them.

What Solos is asking the court to award

Solos seeks compensatory damages, lost profits or at least a reasonable royalty, pre- and post-judgment interest, attorneys’ fees and costs, and a permanent injunction against infringement. It says the alleged infringement could involve damages in the “multiple billions,” but no such amount has been awarded or established by the court.

The complaint also cites Barclays estimates that the Meta-Ray-Ban collaboration generated about $426 million in 2024, could have reached as much as $1.1 billion in 2025, and could reach $10 billion by 2030. These are commercial estimates cited by Solos—not audited damages findings, a court valuation, or an amount Meta has been ordered to pay.

An injunction, if ultimately granted, would require a court order. Its scope would depend on the claims and products at issue and the court’s findings. Filing a request does not itself stop sales, require a recall, or disable glasses already sold.

The separate challenge to the ’339 patent

On June 18, 2026, Meta and Luxottica filed inter partes review petition IPR2026-00376, challenging claims 1–16 of Solos’ U.S. Patent No. 12,216,339 before the Patent Trial and Appeal Board. The petition summary describes arguments that the claims are obvious in light of prior-art references including Asukai, Shan, and Liu, with additional combinations involving Lisy. It also describes a stipulation concerning certain overlapping invalidity arguments in the district-court case if the PTAB institutes review.

A petition is a request for review, not a decision that a patent or its claims are invalid. The PTAB must decide whether to institute the proceeding; if it does, a later final written decision would be needed before saying the challenged claims were invalidated. No institution decision was verified in the available materials as of August 18, 2026. The petition summary describes the filing.

The court’s ruling on Solos’ attempt to disqualify counsel

Solos asked the court to disqualify Morgan Lewis, which represents Oakley, Luxottica, and EssilorLuxottica, citing the firm’s earlier work for Kopin. Solos acquired Kopin’s smart-glasses division and related intellectual property in 2019. On April 6, 2026, Judge Burroughs denied the motion, finding that the earlier work was not substantially related to the present infringement dispute and that Solos had not shown the firm possessed relevant confidential information usable against it.

That ruling addressed whether the law firm could represent those defendants. It did not resolve patent validity, infringement, or the merits of Solos’ case. The court order contains the decision.

What the lawsuit means for smart-glasses buyers

  • It does not automatically halt sales. A complaint is not an injunction, and the filing itself does not require a retailer or manufacturer to stop selling a product.
  • It does not automatically affect current owners. The case is between the named parties. The filing alone does not make owners liable, require them to return glasses, or disable devices.
  • Possible product effects depend on what happens next. A settlement, license, redesign, software change, or court order could affect particular products or features, but none follows automatically from the lawsuit.
  • Do not treat the case as a product verdict. It does not establish that every Ray-Ban Meta or Oakley Meta feature is covered by every asserted patent, nor does it decide questions such as privacy practices or long-term product support.

For current product details, availability, and any software or hardware changes, buyers should consult the official Ray-Ban Meta product page and the relevant manufacturer’s current listings. The lawsuit does not establish whether a product will remain available or receive particular future features.

What happens next

The parties may litigate the defendants’ responses, patent scope and validity, and whether specific products meet the asserted claims. District-court proceedings can include discovery and claim construction, while the PTAB separately decides whether to institute review of the ’339 patent and, if instituted, whether the challenged claims survive. The dispute could also end through settlement, licensing, dismissal, or judgment. As of August 18, 2026, available docket summaries list the district case as open; they do not verify a settlement, trial, final judgment, claim-construction ruling, or final PTAB decision.

There is no substantive public merits response from Meta or EssilorLuxottica established in the sources cited here. The complaint records Solos’ position, not an admission by the defendants. The case’s docket status can be followed through the available case overview.
