“They wish this technology didn’t exist”: Perplexity responds to News Corp’s lawsuit

Perplexity framed News Corp’s lawsuit as opposition to AI, but the reported allegations concerned copying, attribution and competition. The claims were not court findings.

On October 24, 2024, Perplexity answered a copyright lawsuit brought on behalf of Dow Jones and the New York Post with a combative public statement. It cast the litigation as resistance to artificial intelligence; the allegations, as reported at the time, were more specific: copying publisher material, reproducing article passages, misattributing information and competing for publishers’ audiences. Those claims had not been established by a court.

What News Corp alleged

News Corp is the parent company; the publishing businesses identified in coverage of the lawsuit were Dow Jones and the New York Post. Dow Jones operates The Wall Street Journal, but that does not mean the newspaper itself was a named plaintiff. TechCrunch’s October 24, 2024 report described allegations that Perplexity copied content from the publishers on a substantial scale, reproduced chunks of articles, misattributed information and used publisher reporting to answer users directly, potentially competing with the publishers’ own products. TechCrunch’s report summarized the dispute; these remain allegations, not findings.

The same report said the complaint described a July 2024 letter from News Corp raising concerns and offering to discuss licensing. Perplexity disputed the account of what happened next. Without the underlying correspondence, the two sides’ descriptions cannot be reconciled.

What Perplexity said in response

Perplexity’s roughly 600-word response, published on October 24, 2024, was also listed on its official blog index as “About the Dow Jones lawsuit.” The company described the case as “shortsighted, unnecessary, and self-defeating” and placed it in a broader dispute between media companies and generative-AI firms.

It framed the lawsuits as opposition to AI

Perplexity said the common thread in roughly three dozen lawsuits by media companies was that publishers “wish this technology didn’t exist.” It argued that publishers wanted control over the use of publicly reported facts. The figure was Perplexity’s characterization, not an independently verified count, and the statement did not show that every publisher shared the same position.

It disputed the claim of full-article regurgitation

Perplexity rejected the idea that its answer engine simply reproduced complete articles. It said that when excerpts were used, the system could link to the relevant source. That was the company’s account, not independent confirmation that every disputed answer contained a link or that the amount of text shown was legally permissible.

It challenged the account of pre-lawsuit contact

Perplexity said it responded to News Corp’s outreach on the same day. That conflicts with the lawsuit’s reported allegation that the company did not respond to a July letter. The public statements alone do not settle whether a response was sent, what it said or whether it addressed the publishers’ concerns.

It questioned the complaint’s examples

Perplexity suggested News Corp might later abandon or disavow some of the complaint’s more sensational examples. That was speculation by Perplexity, not evidence that the examples were withdrawn or that a court had rejected them.

What the statement did not resolve

The central disagreement was not settled by arguing that publishers oppose AI. News Corp’s reported theory concerned alleged copying at scale and competition for the audience that would otherwise visit publisher sites. Perplexity’s response defended its broader approach and disputed particular characterizations, but TechCrunch reported that it did not directly resolve those core allegations.

  • How much was reproduced? A source link does not by itself answer whether an answer included too much protected wording or other expressive material.
  • What did users receive instead of a visit? Whether an answer substitutes for a publisher’s product may depend on the query, the completeness of the answer and user behavior.
  • What exactly happened in the disputed examples? Complaint examples may illustrate allegations, but without the underlying materials and methodology they should not be treated as representative output.

The available coverage did not establish the precise causes of action, damages sought, full set of disputed examples or later procedural history. It is therefore not possible from these sources to say which legal theories the court would decide or what the case ultimately established.

Why publisher partnerships complicate the “anti-AI” framing

TechCrunch reported that News Corp had a multi-year partnership with OpenAI to make its journalism available within ChatGPT. It also reported content-sharing or revenue-sharing relationships between Perplexity and publishers including Time, Fortune and Der Spiegel. Those arrangements suggest that the fight is not simply over whether AI should exist. Publishers can support some AI distribution while objecting to a particular company’s use, terms, attribution or effects on audience and revenue.

These partnerships do not decide whether any specific use is lawful. A license with one company does not automatically cover another company’s systems, and a willingness to license content does not by itself prove that every unlicensed use infringes copyright.

The questions at the heart of AI search disputes

Perplexity presents itself as an AI-powered answer engine: it retrieves web material and generates answers with source links. That makes this dispute different from a claim focused only on what a model absorbed during training. The reported allegations also raise questions about what a system retrieves, reproduces, summarizes and displays in response to a live query. The available coverage does not establish whether the lawsuit concerned training, retrieval, answer display or some combination.

Facts and expression are not the same thing

Perplexity’s argument about publicly reported facts does not settle whether copying an article’s wording, distinctive presentation or organization is permissible. The legal analysis would have to distinguish the underlying information from the publisher’s expression and examine what the system actually used and showed.

Retrieval, excerpts and links require evidence

Showing a short excerpt with a citation is not the same as supplying a substantial portion of an article, but the boundary cannot be inferred from the existence of a source link alone. Relevant evidence would include the articles and passages at issue, the prompts and outputs, how the system retrieved the material, and how the output affected access to the publisher’s work.

Access controls and licensing are separate parts of the picture

Crawler behavior, robots.txt directives, terms of service and technical access controls may matter to how a system obtained material, but the public response described by TechCrunch does not establish their role in this case. Likewise, commercial licensing can clarify the parties’ terms without automatically resolving every copyright or competition question.

The outcome is not decided by the rhetoric

Whether an AI answer engine lawfully uses publisher material depends on the specific conduct and legal claims, not on whether either side describes the dispute as a fight over innovation. Perplexity’s statement sharpened the public-relations conflict; it did not establish that News Corp opposed AI generally or answer whether the alleged copying and audience competition occurred.
