What South Korea said Meta did
In an enforcement action reported on November 5, 2024, the PIPC described a chain from ordinary Facebook activity to sensitive advertising classifications. According to Reuters’ account of the regulator’s findings, Meta analyzed signals such as pages users liked and ads they clicked, then created or managed advertising themes associated with sensitive characteristics. Those themes were reportedly used by about 4,000 advertisers.

The regulator’s findings, as reported by Reuters, involved approximately 980,000 Facebook users in South Korea. Reported examples of sensitive categories included religion, political views, sexual orientation, transgender identity, and whether someone was a North Korean defector. The reporting also refers to other sensitive characteristics.

South Korean privacy law gives heightened protection to sensitive personal information. Processing it generally requires a specific legal basis and appropriate user consent or agreement. The PIPC concluded that Meta’s approach to collecting and using sensitive information for personalized advertising did not satisfy the applicable requirements, according to Reuters’ reporting.

It was the use of information or inferences tied to sensitive characteristics without meeting the heightened legal conditions for that kind of processing. What the 21.62 billion-won penalty means
The fine was 21.62 billion South Korean won. Contemporary reporting converted that to approximately $15.67 million, but the dollar equivalent depends on the exchange rate; the won amount is the more durable figure. The fine was imposed on Meta, not on each advertiser reportedly using the classifications.

The PIPC also reportedly found problems with Meta’s handling of users’ requests to access their information and a failure to prevent hackers from exposing information concerning about 10 South Korean users. These were additional findings, distinct from the advertising issue affecting the much larger reported population. Korea JoongAng Daily’s coverage also reports additional corrective obligations associated with the action.
Was this a data breach?
Not in the usual sense of a single intrusion exposing the information of all affected users. The central issue was the alleged unlawful processing and advertising use of sensitive information. The reported hacker-related exposure involved information concerning about 10 users and was a separate security finding; it was not the source of the roughly 980,000-user advertising issue.

How the 2024 action differs from Meta’s 2022 Korean fine
South Korea had already fined Meta in a separate 2022 case involving behavioral-data collection and personalized advertising. The matters concern related advertising practices but are not the same enforcement action.

In the 2022 action, South Korea fined Google and Meta a combined 100 billion won: 69.2 billion won for Google and 30.8 billion won for Meta. Meta said at the time that it disagreed with the decision and would consider options including legal action, according to Yonhap’s report. That was Meta’s response to the earlier case, not a response to the 2024 sensitive-data action.

On January 22, 2025, the Seoul Administrative Court upheld the separate 2022 sanctions against Meta and Google, according to the South Korean Ministry of Justice. That court ruling concerns the 2022 case; it should not be treated as a court judgment on the 2024 PIPC action.
What Meta said about the 2024 action
Reuters reported that a Meta Korea official declined to comment on the 2024 decision. That does not amount to an admission of liability or acceptance of the regulator’s findings.
What the case means for Facebook users and advertisers
For users
The case illustrates how seemingly ordinary platform activity can contribute to sensitive inferences. Not entering a trait in a profile does not necessarily prevent a platform from attempting to infer it from engagement. An ad-interest label may also fail to show users every internal classification or the data behind it. The decision does not establish that removing an ad-interest label deletes the underlying data.
For advertisers
Advertisers should not assume a targeting category is lawful merely because a platform offers it. A campaign involving religion, political affiliation, sexual orientation, gender identity, refugee or immigration status, health, or another protected characteristic may raise privacy issues. Responsibility depends on the jurisdiction, campaign, consent framework, and the roles of the platform and advertiser. The reported Korean penalty was against Meta; the available reporting does not say that all 4,000 advertisers were independently fined or accused of wrongdoing.
For the wider advertising market
The enforcement highlights a practical distinction for ad systems: a platform can create privacy risk through an inference, even when a marketer does not receive the underlying personal record. For companies evaluating targeted-ad campaigns, the relevant questions include what data or inferred traits shape an audience, what users were told, what legal basis applies, and whether the campaign uses sensitive categories under local law.
