DOJ, USDA Investigate Meatpackers Over Beef Prices: What We Know

DOJ says its investigation of major meatpackers is underway, not that price fixing has been proven. Here’s what officials have said about the companies, market concentration, USDA enforcement and consumer prices.

The Justice Department says its investigation into the nation’s largest meatpacking companies is underway, but it has not announced a finding that they fixed beef prices or violated the law. USDA is separately directed to strengthen enforcement of livestock-market rules and coordinate with DOJ. The inquiries come amid a tight cattle supply and other pressures that can affect beef markets.

Why are DOJ and USDA investigating meatpackers?

Federal officials publicly addressed antitrust investigations into meatpacking operations at a May 4, 2026 press conference featuring Acting Attorney General Todd Blanche, Agriculture Secretary Brooke Rollins, and Director of Trade and Manufacturing Peter Navarro. DOJ’s announcement records the event.

In remarks updated June 17, 2026, Nicole Sarrine, Deputy Assistant Attorney General in DOJ’s Antitrust Division, said the investigation into the country’s largest meatpacking companies was “well under way.” She said DOJ had not decided what the evidence would show: “It is important to add that we have not prejudged any outcomes of the thorough and vigorous investigation that we are conducting. As with all of our enforcement matters, the Antitrust Division is guided by the law and the facts.” Sarrine’s full remarks describe the inquiry’s status, not a finding of liability.

Are meatpackers fixing beef prices?

That has not been established in the official materials cited here. An investigation means officials are examining potential violations; it is not proof that companies colluded, manipulated prices, or broke the law. DOJ has explicitly said it has not prejudged the outcome, and the cited sources do not report a final result or provide an evidentiary record establishing price fixing.

Beef prices also reflect supply conditions. Sarrine pointed to a historically low cattle herd, drought affecting major cattle-producing states, and New World Screwworm as serious pressures. Those conditions are relevant market context, not evidence of collusion, and do not by themselves resolve whether any particular conduct violated antitrust law.

Which companies are named, and what does the 85% figure mean?

Sarrine described the “Big Four” as accounting for 85 percent of U.S. beef processing. In a separate May 15, 2026 announcement of a Texas investigation, Attorney General Ken Paxton named JBS S.A., Tyson Fresh Meats, Inc., Cargill, Inc., and National Beef Packing Co., and described their share as over 85 percent. These are figures attributed to officials, not a market-share calculation independently established by the cited excerpts.

The cited materials do not explain the market definition or methodology behind either estimate. A concentration figure can explain why officials are examining competition, but it does not alone prove that a company engaged in unlawful conduct. Paxton’s announcement describes a separate Texas investigation and allegations of possible anticompetitive conduct; it does not establish wrongdoing. The Texas Attorney General’s release sets out that state inquiry.

What has USDA said, and how does its role differ from DOJ’s?

A September 4, 2026 executive order directs USDA to prioritize and expand investigations into potential violations of the Packers and Stockyards Act. The order identifies unfair, discriminatory, or deceptive practices and conduct that restrains commerce or manipulates prices, and calls for close coordination with DOJ, including referrals or complementary antitrust action where appropriate. The White House order states the directives; USDA’s announcement describes stronger enforcement, additional resources and staffing, and continued coordination with DOJ.

  • USDA: administers and enforces the Packers and Stockyards Act. The executive order directs the department to prioritize potential violations and work closely with DOJ.

The order sets enforcement priorities; it does not announce that a particular meatpacker has violated the law or dictate what the ongoing DOJ inquiry will find.

How is this different from Texas’s investigation and private lawsuits?

There are multiple proceedings, and an allegation in one is not a government finding in another. Texas announced its own investigation on May 15, 2026. DOJ also said it was monitoring private cattle and beef antitrust cases. Private lawsuits contain plaintiffs’ allegations; they are distinct from DOJ’s investigation and do not establish the government’s conclusions.

Will the investigation lower beef prices?

No price reduction or timeline is established in the cited announcements. An investigation may result in enforcement if officials find a legal violation, but these sources do not forecast whether or when that would affect cattle, wholesale beef, or grocery prices. Supply pressures such as drought and a low cattle herd are separate factors that can influence the market.
