The interpretation described protections for billing disputes, refunds and periodic statements. The CFPB withdrew that interpretive rule on May 12, 2025, so it is no longer current agency guidance.
What the CFPB’s BNPL interpretation covered
The May 22, 2024 interpretation addressed lenders that issue digital user accounts consumers use to access credit for purchases. It focused on a defined kind of account, not every product marketed as BNPL. The CFPB described traditional BNPL as closed-end credit repaid in four or fewer installments without a finance charge, while noting that market offerings vary. The Bureau’s BNPL resource page provides its current resource and status information.
Under the interpretation, the covered digital accounts could qualify as “credit cards” for Regulation Z purposes, making their lenders “card issuers” and “creditors” subject to relevant rules in subpart B. The interpretation did not mean that BNPL loans became subject to every credit-card regulation.
What protections the 2024 interpretation described
In its May 22, 2024 announcement, the CFPB said the interpretation meant covered lenders would have to:

- Investigate consumer-initiated billing disputes, pause payment requirements while investigating and, in some cases, issue credits.
- Credit refunds when consumers returned goods or cancelled services.
- Provide periodic billing statements.
These were protections the agency said applied under its interpretation at the time. The CFPB later withdrew that guidance; the announcement describes what the Bureau said in 2024, not current agency guidance.
Why this was not “all credit-card rules” for BNPL
The interpretation distinguished between Regulation Z’s subpart B billing protections and subpart G’s rules for credit-card accounts. The CFPB said traditional BNPL loans were not open-end credit and generally were not subject to subpart G requirements, such as penalty-fee limits and ability-to-repay rules. The distinction matters: the 2024 interpretation applied specified provisions to certain accounts, rather than making all BNPL loans equivalent to conventional credit cards. Why returns and disputes were part of the debate
The CFPB’s 2024 announcement reported that more than 13% of BNPL transactions involved a return or dispute, and that $1.8 billion in transactions were disputed or returned in 2021 at five surveyed firms. Those are historical figures tied to the transaction year and the five-firm survey—not estimates for the entire BNPL market today.
What changed when the CFPB withdrew the rule
The CFPB’s withdrawn-guidance listing and current BNPL resource page state that it withdrew the May 2024 interpretive rule on May 12, 2025. That means the 2024 interpretation should not be presented as current CFPB guidance.

Withdrawal of the interpretation is not the same as repeal of the Truth in Lending Act or Regulation Z. The withdrawal changes the status of that agency guidance; it does not, by itself, settle every legal question about a particular lender, account or loan. The sources cited here do not establish a comprehensive current legal determination for every BNPL product.

Because BNPL products and terms vary, review the agreement for the particular purchase. Check the payment schedule, how returns and cancellations affect payments, how to dispute a charge, and whether the provider explains what happens while a dispute is investigated. Do not assume every provider offers the same process or that the withdrawn 2024 interpretation governs your account.

CFPB Director Rohit Chopra said when the interpretation was issued: “Regardless of whether a shopper swipes a credit card or uses Buy Now, Pay Later, they are entitled to important consumer protections under longstanding laws and regulations already on the books.” That statement reflected the Bureau’s 2024 position; the interpretation was withdrawn in 2025.
