A proposed Federal Court class proceeding alleges that Costco Wholesale Canada Ltd. charged more for some products online than in its warehouses and made misleading disclosures about delivery charges and in-store availability. Those allegations have not been proven, and the latest court authorization status is not verified in a current primary court record.
What does the lawsuit allege?
Ibrahim El Bechara filed the proposed proceeding against Costco Wholesale Canada Ltd. in the Federal Court on December 23, 2024, under file T-3644-24. The English translation of the statement of claim alleges that some identical goods cost more through Costco.ca or the Costco app than in a warehouse. The plaintiff characterizes this as double ticketing. The pleading also alleges misleading representations about whether extra charges applied and whether goods bought online were available in-store. Global News, reporting on the pleading on January 14, 2025, cited two alleged comparisons: a 26-piece Glasslock food-storage set at $44.99 online and $34.99 in-store, and a Kirkland Signature 10-cup pitcher with two filters at $31.99 online and $24.99 in-store. Does Costco charge more online?
Costco says online and warehouse prices can differ. Its Canadian customer-service page attributes online price differences to shipping and handling for delivery to a home or business. Costco says it does not price-match in either direction between Costco.ca and warehouses; an online product page may also indicate that an item could be available at a local warehouse for immediate cash-and-carry purchase. The plaintiff disputes whether Costco’s explanations and disclosures adequately informed shoppers. The statement of claim alleges that checkout showed shipping and handling as $0.00, while product pages described standard delivery as included in the listed price. That is the plaintiff’s account of the purchase path, not a finding that Costco’s disclosures were misleading. Who would be included in the proposed class?
The proposed class definition covers people in Canada who, on or after December 23, 2022, bought a product through the Costco app or Costco.ca and paid more than the price displayed in a Costco store for the same product. For a price comparison to be meaningful, the product, price, time, and terms need to match. Different sizes or product identifiers, sale periods, or locations can make two prices non-comparable. The pleaded examples illustrate the allegation; they do not establish that every online and warehouse price difference involved the same circumstances.
What does the Competition Act have to do with the case?
The pleading invokes section 54 of the Competition Act in connection with alleged double ticketing, and sections 52(1) and 52.01(2) in connection with alleged misleading representations. Global News described the Act’s double-ticketing prohibition as addressing a seller charging the higher of two or more clearly expressed prices. Whether the pleaded facts meet the law’s requirements, and whether Costco contravened the Act, remain matters for the proceeding—not conclusions established by the filing. Has the class action been approved, and can shoppers claim money?
Global News reported on January 14, 2025, that the proposed action still required court approval. The law firm’s case page describes it as a class proceeding, but the materials cited here do not establish a current authorization decision. A secondary legal-industry listing shows dates associated with the file but does not include the underlying court order or explain the event, so it cannot establish the outcome. The latest authorization and procedural status as of October 8, 2026, is therefore unverified against a current Federal Court docket entry or order.
The law firm says registration with counsel is not mandatory and is not a compensation claim. It says a separate claims process would be implemented if the action succeeds on the merits.
