Reporting says health-care executive Anthony Welters lent Clarence Thomas $267,230 in 1999 to buy a luxury motor coach. Years later, Thomas wrote the Supreme Court’s unanimous opinion in an ERISA case that displaced the state-law claims before the Court. That juxtaposition invites scrutiny, but the available sources do not establish a link between the loan and the ruling.
What was the RV loan?
In 1999, Thomas received a reported $267,230 loan from Anthony Welters to purchase a Prevost Le Mirage XL Marathon motor coach. Welters was identified in reporting as a health-care executive. The loan later drew attention because of both its size and the lender’s industry connection.
Was the loan repaid or forgiven?
In a 2023 report, Senate Finance Committee Democrats said materials Welters provided indicated that the loan was forgiven in 2008 and did not show repayment of principal. The committee raised questions about tax treatment and disclosure. Those are the committee’s interpretations of the records, not findings by a court or a tax authority.
Thomas’s lawyer disputed the description that the loan was forgiven. The sources available here do not resolve that dispute, so it is not established whether the debt was repaid, forgiven, or otherwise settled. In 2024, committee chair Ron Wyden summarized the committee’s view as a loan for a luxury RV on which most, and possibly all, of the money had not been repaid. That statement likewise describes the committee’s position rather than an independent adjudication.

What did the Supreme Court decide in Aetna Health Inc. v. Davila?
In 2004, the Supreme Court decided Aetna Health Inc. v. Davila, 542 U.S. 200. The plaintiffs alleged that health plans had wrongfully denied coverage for treatment and brought claims under state law. Justice Thomas authored the Court’s unanimous opinion.
The Court held that the state-law claims before it were preempted by ERISA because they fell within the federal statute’s civil enforcement scheme. In the opinion’s description, ERISA allows a participant or beneficiary to seek benefits due under a plan, enforce rights under the plan, or clarify rights to future benefits. The ruling concerned which legal framework and remedies applied to those claims; it did not decide that every denied treatment claim is valid, or that every patient is left without a remedy.

What connects the loan to the case—and what does not?
The connection documented in the sources is a juxtaposition: a health-care executive reportedly lent money to a Supreme Court justice, and that justice later wrote an opinion about ERISA’s limits on state-law claims over health-plan decisions. The sources do not show that Welters had a financial stake in Davila, sought a particular ruling, or was a party to the case. They also do not establish that the loan influenced Thomas’s opinion or vote.
That distinction matters. A lender’s industry and a case’s subject can make a relationship worthy of questions without proving a financial conflict, an exchange, or a causal connection. The loan’s terms and its later status are also contested; the committee’s concerns should not be presented as a court finding.

Does this establish why American health care “sucks”?
No. Davila illustrates a specific legal limit: when a claim falls within ERISA’s civil enforcement scheme, state-law claims of the kind before the Court can be preempted. That can narrow which remedies a patient may pursue, but the case and loan records do not measure U.S. health-care costs, access, outcomes, or performance against other countries. They cannot, by themselves, support a system-wide verdict about American health care.
