Who Pays GST on App-Cab Rides in India: Platform, Driver or Passenger?

In India, the platform may be liable for GST on a notified app-cab ride supplied through it. The driver’s role and who receives the fare do not decide liability on their own.

For a notified passenger-transport service supplied through an e-commerce operator, the platform is liable to pay GST to the government under section 9(5) of India’s CGST Act. The driver may provide the ride and the passenger may pay the fare, but neither fact alone decides who must remit the tax. The key question is whether the ride service is supplied through the platform.

Who is legally responsible for GST on an app-cab ride?

Section 9(5) places liability on an electronic commerce operator for specified services supplied through it. CBIC explains that, for those notified services, the operator is treated as the supplier liable to pay the tax. The relevant notifications include Notification No. 17/2017-Central Tax (Rate) and Notification No. 14/2017-Integrated Tax (Rate). See CBIC’s Sectoral FAQ.

Passenger transport by motorcab, maxicab, motorcycle or another motor vehicle other than an omnibus is among the notified categories when supplied through an operator. An app’s involvement alone does not establish that every ride meets this condition; the operator’s role in the particular supply matters.

Does paying the driver directly change who pays?

Not by itself. In an advance ruling concerning Uber India, the authority concluded that a passenger’s direct payment to the driver did not prevent section 9(5) liability from attaching to the operator where the notified ride service was supplied through the platform. That ruling illustrates the rule for the applicant’s facts; it is not a blanket determination for every app or payment arrangement. The West Bengal Yatri Sathi ruling demonstrates the other side of the distinction: although the applicant was an e-commerce operator, the authority found that the particular driver ride services were not supplied through it for section 9(5) purposes. Advance rulings apply to their applicants and the facts considered, so neither decision automatically settles the treatment of another platform’s model. Read the Yatri Sathi advance ruling.

Who bears the cost in the fare?

Statutory liability and economic cost are different questions. Section 9(5) identifies who must remit the tax to the government; it does not establish who ultimately bears the cost under every fare structure. The invoice, app pricing and contractual terms determine what the passenger is charged and how the tax is shown. A GST line in a fare does not by itself make the passenger the statutory remitter, just as payment to the driver does not by itself make the driver responsible for remitting it.

What GST rate applies to app-cab rides?

CBIC’s rate table lists passenger transport by radio taxi at 5% for the listed category, expressed as 2.5% central tax plus 2.5% state tax for an intra-state supply, subject to applicable conditions. It also lists passenger-motor-vehicle transport where fuel cost is included in the consideration at 5%, subject to input-tax-credit restrictions. These figures should not be generalized to every app ride or every fare component. Check the current category and conditions in CBIC’s GST rates table.

The table separately lists metered cabs and auto-rickshaws among exempt transport services, but states that this exemption does not apply to services supplied through an e-commerce operator and notified under section 5(5) of the IGST Act. The applicable treatment depends on the ride category, whether the supply is intra-state or inter-state, and the current notification wording.

Does the driver need to register or pay GST?

CBIC says suppliers of services for which an operator pays tax under section 9(5) are entitled to threshold exemption. That treatment is tied to the notified services and the relevant operator arrangement; it is not a general exemption for every driver who uses an app. A driver’s obligations in a particular case may depend on other supplies and circumstances not resolved by the ride-level rule.

How to check the GST on a particular ride

  1. Open the tax invoice or fare breakdown. Check the service or vehicle category and how GST is identified.
  2. Check who is identified as supplier or liable operator. Look for whether the platform is treated as liable under section 9(5); do not rely only on who collected or received the fare.
  3. Compare the stated rate with the ride category and supply type. Consider the applicable input-tax-credit conditions and whether the supply is intra-state or inter-state.
  4. If the charge is unclear, ask the platform for the applicable GST invoice and the basis for the rate. The invoice and your contractual arrangement are needed to assess a specific ride.
