Sometimes—but only when the law where the incident happens permits it. In the United States, a retailer or its employees may have a limited “shopkeeper’s privilege” to detain someone they reasonably believe has committed or attempted theft. The detention generally must be reasonable in how it is carried out and how long it lasts. State law and the incident’s specific facts determine whether a particular stop was lawful; the sources here do not establish Target’s internal policy.
What legal authority can store security have?
Retail security staff are not law enforcement simply because they work for a store. Their authority to restrain a customer, if any, comes from applicable state law. One legal concept is shopkeeper’s privilege: a limited defense that may allow a merchant or its personnel to detain someone to investigate suspected theft.
Cornell Legal Information Institute’s overview of shopkeeper’s privilege describes the general rule as requiring a reasonable belief that a customer is committing theft, along with a detention conducted in a reasonable manner and for a reasonable time to investigate. This is a general legal overview, not a substitute for the law controlling in a particular state.
The concept matters because intentionally confining someone without consent or legal authority may amount to false imprisonment. Whether a privilege applies depends on the relevant law and circumstances; the label “loss prevention” does not by itself establish authority to hold someone.

How does state law change the answer?
There is no single rule that can resolve every Target stop nationwide. State statutes and court decisions define the circumstances in which a private person may detain or arrest someone. Cornell LII’s citizen’s-arrest overview notes that these rules are state-specific; its examples of Texas and California should not be treated as a national standard.
Texas example
Texas Civil Practice and Remedies Code § 124.001(a) provides a concrete statutory example. The Texas Legislature states: “A person who reasonably believes that another has stolen or is attempting to steal property is privileged to detain that person in a reasonable manner and for a reasonable time to investigate ownership of the property.” Read the Texas statute, § 124.001 as Texas law only—not as a statement of Target policy or a rule for other states.

Texas Penal Code § 9.43 separately addresses certain uses of force to protect property and says reasonable measures must be taken to end confinement as soon as the actor knows they safely can, subject to the statute’s conditions. That provision is related, but it is not a complete rule for every retailer detention. See Texas Penal Code § 9.43.
What makes a particular detention more or less likely to be lawful?
A general rule cannot decide an individual case without the applicable jurisdiction and facts. The main questions are:

- Which state’s law applies? The rules for private detention and citizen’s arrest vary by state.
- What supported the suspicion? The legal framework described above turns on a reasonable belief that theft occurred or was attempted. What an employee actually observed may matter.
- How was the customer restrained? The manner of detention must meet the standard under the applicable law. The Texas statute, for example, expressly requires a reasonable manner.
- How long did it last, and what was being investigated? The general shopkeeper’s-privilege overview and Texas statute limit detention to a reasonable time for investigation; Texas § 124.001 specifies investigating ownership of property.
These are issues for evaluating a specific event, not a formula that guarantees a legal outcome. The available information does not establish what happened in any particular Target incident.
Does Target have a policy that lets security hold customers?
The sources cited here do not establish Target’s current internal policy on detaining suspected shoplifters. It would be inaccurate to describe the general shopkeeper’s-privilege rule as “Target’s policy.” A retailer’s internal procedures also do not, by themselves, settle whether a detention complies with state law.

What should you do if you are being held?
If you are involved in a real incident, prioritize your immediate safety. Avoid escalating a physical confrontation. If you can do so safely, ask whether you are free to leave and request that law enforcement be contacted. Note the location, timing, what was said, who was present, and what you observed. Because the legal rules depend on state law and the precise facts, consult a lawyer licensed in the state where the incident occurred for advice about your situation.
