California’s AB 1340 took effect on January 1, 2026, creating a collective-bargaining framework for covered rideshare drivers. On September 9, 2026, the California Public Employment Relations Board (PERB) certified the California Gig Workers Union (CGWU) to represent the statewide unit of drivers at covered companies, currently Uber and Lyft. That gives the union authority to represent drivers and bargain over work terms; it does not establish a pay increase or completed contract.
What California’s unionization law changes
The Transportation Network Company (TNC) Drivers Labor Relations Act, created by AB 1340, gives covered California drivers the right to form, join and participate in driver organizations, bargain collectively, or refrain from those activities. PERB administers the certification, representation and bargaining procedures. The Act is codified in California Business and Professions Code sections 7470–7470.21. PERB’s TNC Act page and its rulemaking page describe the framework and its implementation.
Governor Gavin Newsom signed AB 1340 on October 3, 2025; it took effect January 1, 2026. The governor’s signing announcement described the measure as a route to union representation for more than 800,000 rideshare drivers. That broad figure is not the same measure as PERB’s later count of active drivers.
Who is represented—and who is not covered by this certification
PERB certified CGWU for a statewide unit of drivers at covered transportation network companies. The board currently identifies Uber Technologies, Inc. and Lyft, Inc. as covered companies for this unit. This is a sector-wide unit, not a certification limited to drivers at one local workplace or a single company.

The certification should not be read as automatically covering delivery-app workers or every person who works in the gig economy. The scope established in PERB’s announcement is the statewide unit of TNC drivers at the covered companies. PERB’s certification announcement identifies the union, unit and covered firms.
What PERB’s certification means for drivers
PERB announced on September 9, 2026, that CGWU was certified after providing evidence of support from at least 30 percent of active TNC drivers. The board had earlier recorded a 10-percent support determination on June 2, 2026, and a 30-percent determination on August 7, followed by the statutory 30-day period. The September certification announcement establishes the current status: CGWU is certified, not still awaiting certification.

As the certified organization, CGWU may represent all drivers in the unit and bargain with covered TNCs over terms and conditions of work. Representation is not the same as an individual driver receiving a particular raise, benefit or protection immediately. A certification gives bargaining authority; the specific terms, if any, depend on negotiations and an agreement.
What is not yet established
PERB’s September 9 announcement does not identify a bargaining start date, a negotiation schedule, agreed contract language, or resulting wage and benefit terms. Those outcomes should not be assumed from the certification alone.

Implementation rules were also still in process as of October 8, 2026. PERB’s rulemaking page listed proposed regulations and a public-comment deadline of November 3, 2026; those were proposed rules, not final regulations, at that date. Check PERB’s rulemaking page for any later update.

PERB reported 100,307 current active TNC drivers on its public data page, and calculated a median of 475.00 rides for January 1 through June 30, 2026. These are distinct measures: the active-driver count is not the number of people represented by the governor’s broader 2025 estimate of more than 800,000 rideshare drivers. The sources use different dates and measures, so the figures should not be compared as if they counted the same population. See PERB’s TNC Act data and the governor’s signing announcement.
