Spain’s CNMV Warns Against a Forex Broker WandaFX

Spain’s CNMV warned against WandaFX, Eper Holdings Ltd and Bonvita Partners OU on 29 April 2019 for providing specified investment services without the required Spanish authorisation. Here is what the notice says, what it does not prove and how investors can verify the record.

Spain’s securities regulator, the Comisión Nacional del Mercado de Valores (CNMV), issued a public warning on 29 April 2019 concerning the WandaFX website, EPER HOLDINGS LTD and BONVITA PARTNERS OU.

The regulator said the named entities were not authorised to provide specified investment or auxiliary services in Spain, including services involving foreign-currency transactions. The warning remains available in the CNMV’s public database.

That is a significant regulatory warning, but its wording matters: the notice establishes a lack of the required Spanish authorisation. It does not, by itself, amount to a criminal-fraud finding, a court judgment or proof that every customer lost money.

What the CNMV warning says

The CNMV record associates the warning with:

  • wandafx.com
  • EPER HOLDINGS LTD
  • BONVITA PARTNERS OU

In the notice, the CNMV stated that Eper Holdings Ltd and Bonvita Partners OU were not authorised to provide the investment services covered by Article 140 of Spain’s then-applicable Securities Market Law. It also referred to certain auxiliary services under Article 141 and financial instruments covered by Article 2, including foreign-currency transactions.

The English version also refers to services such as investment advice. In practical terms, the warning told investors that the named entities did not hold the Spanish authorisation required for the relevant services at the time of the notice.

The warning date is 2019, not 2023

The CNMV warning was issued on 29 April 2019. Some online articles about WandaFX were later updated, including an update dated 11 April 2023. An article-update date is not the date of the regulator’s warning.

The original notice cited Spain’s consolidated Securities Market Law approved by Royal Legislative Decree 4/2015 of 23 October. Spain now has a newer framework, including Law 6/2023 of 17 March, on Securities Markets and Investment Services. The historical WandaFX notice has not been rewritten as though it were issued under that later law.

What this does—and does not—prove

A warning against an unauthorised investment firm should be treated seriously. A firm offering forex or other financial services without the required authorisation may not provide the investor protections associated with an authorised Spanish investment firm.

However, the notice itself is narrower than some summaries suggest. It does not establish all of the following:

  • that the CNMV made a criminal-fraud finding;
  • that every WandaFX customer lost money;
  • that the directors or owners committed a criminal offence;
  • that the website continued operating after the warning;
  • that the entities had no registration anywhere in the world; or
  • that every product advertised under the WandaFX name was necessarily offered by the two entities named in the notice.

It is also more precise to say that the CNMV warned that the named entities were unauthorised for specified services. Saying that the CNMV “banned” WandaFX overstates what the published notice says. The notice is not described as a separate prohibition, criminal prosecution, sanction or court judgment.

How to check the warning yourself

The CNMV’s current website preserves the warning in its public database. To locate it through the English-language site:

  1. Open Investors and financial education.
  2. Select Warnings (unauthorised firms and other entities).
  3. Choose Search Engine for Warned Companies.
  4. Enter wandafx in the field labelled Type the entity’s full name, or a part of it.
  5. Use the entity-name search option and, where shown, select Unauthorised entities or No authorised.
  6. Review the result dated 29/04/2019.

The CNMV also advises investors to use its authorisation search engine to check whether a firm is authorised for a particular investment service. A firm’s presence in a corporate registry, membership of a private dispute-resolution body or claim of an overseas registration is not the same as authorisation by Spain’s securities regulator.

What prospective customers should do

If you are considering sending money to a forex broker associated with the WandaFX name, pause before depositing. Check the exact legal entity named in the broker’s terms, the domain being used, the regulator claimed by the firm and whether that regulator’s own register confirms the relevant permission.

Do not treat a broker’s claims about “regulation” as conclusive. In particular, secondary broker-review pages have referred to an alleged “Financial Commission” connection, but that claim does not appear in the CNMV warning and should not be presented as proof of government regulation. Likewise, company-registration numbers repeated by secondary sources are not included in the official CNMV notice and should not be treated as verified from that notice alone.

If you have already deposited money, preserve evidence before closing accounts or deleting messages. Keep:

  • account statements and transaction histories;
  • deposit and withdrawal records;
  • emails, chat transcripts and telephone numbers;
  • screenshots of the website, account dashboard and terms;
  • wallet addresses or bank details used for payments; and
  • the exact legal name shown on invoices or payment requests.

Contact your bank, card issuer or payment provider promptly and ask what dispute, recall or fraud-reporting options remain available. Be cautious of anyone promising to recover funds for an upfront fee. A prior loss can make investors vulnerable to a second recovery scam.

Bottom line for investors

The reliable conclusion is straightforward: on 29 April 2019, the CNMV warned that WandaFX’s associated website, Eper Holdings Ltd and Bonvita Partners OU were not authorised to provide specified investment services in Spain, including services related to foreign-currency transactions. The warning is still listed by the CNMV.

That finding is enough to warrant substantial caution and independent verification. It should not be expanded into claims the official notice does not make, such as a proven criminal scam, a blanket ban or evidence of present-day website activity.
