By November 2024, construction reporting described work as stalled and the first phase as on hold; a 2025 lawsuit then raised allegations about how project money was handled. But the court’s May 2026 ruling dismissed only the complaint’s RICO claims on a pleading issue, and the available record does not confirm a formal cancellation. The project’s collapse as a working schedule is clear; its official status and the full state of the site are not.
What American Heartland was supposed to be
Announced in July 2023, American Heartland was a proposed theme park and resort development near Vinita, Oklahoma, close to Grand Lake and Route 66. The developer described a roughly 1,000-acre destination with a 125-acre theme park, rides, live shows, family attractions, waterways, dining, cabins, an RV park and a resort.
The developer projected more than 4.9 million annual visitors and about 4,000 jobs. Those were promotional forecasts, not attendance or employment results: the park did not open. Oklahoma State Sen. Micheal Bergstrom endorsed the proposed location in the announcement, saying, “There’s no better place to represent the heart of America than northeast Oklahoma.”
What happened to the announced schedule?
The original timeline called for the RV park and cabins to open in spring 2025, followed by the theme park and resort in 2026. The first announced phase, the Three Ponies RV Park and Campground, had a groundbreaking ceremony in October 2023. A groundbreaking marked the start of the project’s public schedule; it did not mean the facilities were built or ready to open.

| Measure | July 2023 announcement | Reporting by November 2024 |
|---|---|---|
| Estimated investment | More than $2 billion, the developer’s initial proposed investment (2023 announcement, republished by VS News Network and attributed to Business Wire). | $2.5 billion, a later reported project estimate (Construction Dive, November 2024). The two figures reflect different dates and estimates, not proof of a final amount spent. |
| RV park and cabins | Planned to open in spring 2025 (developer’s announced schedule, 2023). | Work was reported on hold pending permit approvals; Construction Dive said the opening could be delayed by at least three years. |
| Theme park and resort | Planned to open in 2026 (developer’s announced schedule, 2023). | Construction Dive reported no progress a year after the groundbreaking. The reported delays put the announced opening schedule in doubt. |
| Attendance and jobs | More than 4.9 million annual guests and around 4,000 jobs projected by the developer (2023 announcement). | No actual attendance or job-creation figures are established in the cited reporting; the attraction had not opened. |
Why the project stalled
Permits, liens and a rejected funding request
Construction Dive reported in November 2024 that RV park work was on hold pending permit approvals, that the development had not advanced as scheduled, and that two construction and design companies had filed liens. The Journal Record later reported that the two liens, filed in May 2024, involved nearly $6 million in unpaid project claims. A lien records a claim against property for alleged unpaid work or services; it is not, by itself, a judgment establishing that the claim is valid.
The Journal Record also reported that Oklahoma lawmakers declined a requested $35 million appropriation for water and wastewater improvements. That request was a proposed public funding contribution, not evidence that the state had already committed or paid the money.

The reported cost changed
The initial “more than $2 billion” figure came from the developer’s 2023 announcement. Construction Dive reported a $2.5 billion estimate in 2024. These are separate estimates at different points in the project’s development; neither figure establishes how much was ultimately invested, and the later estimate should not be described as a verified final cost.
What the lawsuit says—and what the court decided
In July 2025, The Journal Record reported on a federal complaint by project backer Gene Bicknell. The complaint alleged fraud and coercion and claimed that more than $60 million had been taken. It also alleged that little had been built beyond a fence and gravel road. These are allegations attributed to Bicknell’s lawsuit, not findings that the court established as facts. Asked about the allegations, the project’s senior executive vice president of sales and marketing, Kristy Adams, told The Journal Record: “We have no comment. Thank you.”

| Issue | What the cited record says | What it does not establish |
|---|---|---|
| Money and conduct | Bicknell’s 2025 complaint alleged that more than $60 million had been taken and asserted fraud and coercion (as summarized by The Journal Record). | The alleged amount is not a court-established loss, and the allegations should not be treated as proven. |
| RICO claims | On May 5, 2026, the U.S. District Court dismissed the RICO claims because the complaint did not plead a pattern of racketeering activity. | The ruling did not determine the truth or falsity of every allegation. The court otherwise denied the motions addressed in that order. |
A separate 2026 court order recounted an October 8, 2024 email in which Bicknell’s lawyer wrote, “The theme park will never be built.” That is the lawyer’s opinion as quoted in the order—not a court finding or an official cancellation notice.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Has American Heartland been officially canceled?
The reporting supports describing the project as stalled and as having failed to meet its announced launch schedule. It does not establish that the developer formally canceled it. Construction Dive reported in November 2024 that the developer still said the project was on, even as work was delayed and the RV phase was on hold.

The cited court orders and reporting also do not independently establish the site’s physical condition on October 7, 2026. The complaint’s description of a fence and gravel road is an attributed allegation about the site, not a current, independent inspection. The careful answer is that the ambitious plan did not launch on schedule, while formal cancellation and the latest site conditions remain unconfirmed in the available record.
