Oak View Group co-founder and then-CEO Timothy J. Leiweke was indicted in July 2025 over an alleged agreement to keep a competitor from bidding independently on a planned public-university arena in Austin, Texas. The U.S. Department of Justice later updated its announcement to say Leiweke received a presidential pardon for the offenses alleged. The DOJ announcement describes allegations, not a finding of guilt, and does not give the pardon’s date or terms.
Who was indicted, and what was the project?
The DOJ announced on July 9, 2025, that a federal grand jury had returned an indictment against Leiweke, whom it identified as Oak View Group’s (OVG) co-founder and CEO. The case was filed in the U.S. District Court for the Western District of Texas. The allegations concern the development, management, and use of a planned arena at a public university in Austin. The DOJ announcement was updated January 6, 2026, with a notice that Leiweke had received a presidential pardon for the offenses alleged.
What did prosecutors allege?
According to the DOJ’s description of the indictment, the alleged conspiracy ran from approximately February 2018 through at least June 2024. Prosecutors say that before the alleged agreement, Leiweke discussed how to respond to a competing venue-services company’s bid, including the possibility of offering it some work if it stopped competing.
The DOJ says that in February 2018 Leiweke reached an agreement with the competitor’s CEO: the competitor would not submit or join an independent competing bid, in exchange for a representation that it would receive subcontracts on the arena project. The competitor did not submit a competing bid. OVG submitted the sole qualified bid and won, according to the DOJ. The arena opened to the public in April 2022. These are the government’s allegations and account of the outcome, not findings established by a court in the cited announcement.

What was the charge and what penalties did DOJ describe?
The DOJ said Leiweke was charged with violating Section 1 of the Sherman Act, the federal antitrust law cited in the indictment. In its 2025 release, the DOJ described the maximum individual penalties as follows:

The DOJ said a judge would determine any sentence if Leiweke were convicted. Its release also said OVG agreed to pay $15 million and Legends Hospitality agreed to pay $1.5 million in penalties in connection with the conduct alleged against Leiweke. Those figures are the DOJ’s stated amounts and are distinct from the individual maximum penalties.

What does the pardon notice establish?
The DOJ’s January 6, 2026 update says: “Timothy Leiweke, received a pardon from the President of the United States for the offenses alleged in the indictment described in the press release below.” The notice establishes that DOJ reported a pardon; it does not state the date of the pardon, provide the pardon instrument, explain its terms, or give a current docket account. The announcement alone therefore does not support a more specific description of the pardon’s legal effect or of the case’s present procedural status.

The DOJ announcement reports an indictment and later a pardon notice; it does not report a conviction. An indictment is an accusation, not proof. The DOJ expressly states that defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in court. That distinction matters here: the alleged agreement, bid outcome, and conduct should not be presented as adjudicated facts.
