Agriculture Industry Reacts to Mexico GM Corn Dispute Outcome

U.S. agriculture groups welcomed the USMCA panel’s ruling on two Mexican biotech-corn measures, while civil-society groups criticized it. Mexico declared the measures ineffective in February 2025.

U.S. grower and corn-processing groups welcomed a December 20, 2024 USMCA panel ruling against two measures in Mexico’s 2023 biotech-corn decree. Civil-society organizations criticized the decision, citing food sovereignty, Indigenous rights, and biodiversity. Mexico declared the challenged measures ineffective on February 5, 2025, while the U.S. Trade Representative said it would monitor compliance. The ruling addressed those specified measures—not every Mexican policy on corn or biotechnology.

What the USMCA panel decided

The panel issued its final report to the parties on December 20, 2024, and agreed with the United States on all seven claims. It found the challenged measures inconsistent with USMCA requirements and concluded that they undermined agreed market access. The legal outcome concerned provisions of Mexico’s February 2023 decree, not biotechnology policy in general. The USTR announcement of the decision and the panel’s final report describe the ruling and its reasoning.

The two sets of measures at issue

  • Use in dough and tortillas: an immediate ban on using genetically engineered (GE) corn in dough and tortillas.
  • Other food uses and animal feed: a direction to Mexican agencies to gradually substitute GE corn for other uses in food and animal feed.

Mexico argued that the decree regulated use, rather than imports. The panel nevertheless concluded that the restriction on corn for direct human consumption could affect imports in practice. It also treated the instruction to agencies on gradual substitution as a measure that could affect trade. That legal analysis concerned the measures’ relationship to USMCA obligations; it did not resolve the broader political or scientific debate over biotechnology. The panel report sets out the analysis.

Why agricultural groups supported the outcome

The National Corn Growers Association (NCGA) welcomed the ruling. Its president, Kenneth Hartman Jr., credited growers’ advocacy and said the association would work with the Office of the U.S. Trade Representative (USTR) and the incoming administration to ensure enforcement. That is the association’s response, not a separate panel finding. NCGA’s statement provides its position.

The Corn Refiners Association (CRA) also welcomed the decision, arguing that science-based trade rules and agricultural innovation benefit producers and consumers. Its statement reflects the trade group’s view of the ruling and its implications. CRA’s announcement explains its response.

Why civil-society groups criticized it

The Institute for Agriculture and Trade Policy (IATP) and other civil-society organizations opposed the ruling. Their criticism was that the panel gave insufficient weight to food sovereignty, Indigenous rights, biodiversity, and Mexico’s policy goals. These are advocacy groups’ arguments about what the decision should have considered; they are not findings made by the panel. IATP’s response presents its critique.

At the heart of the disagreement are different priorities: the panel assessed whether the specified measures complied with USMCA market-access requirements and the agreement’s relevant framework, while critics emphasized Mexico’s policy objectives and social, cultural, and environmental concerns. Keeping those questions distinct helps avoid treating either the ruling or a stakeholder’s reaction as a final answer to the broader debate.

What Mexico did after the ruling

On February 5, 2025, Mexico published an action declaring ineffective the two sets of measures the United States had successfully challenged. USTR welcomed the step and said it would monitor Mexico’s compliance with its USMCA commitments. The available post-ruling status establishes that action and the stated monitoring; it does not establish that debate over Mexican biotech policy has ended. USTR’s February 2025 statement describes its response.

Mexico’s Economy and Agriculture ministries offered their own framing in a joint communication on December 20, 2024, saying the panel’s conclusion applied to decree elements that were not based on an adequate risk assessment, scientific evidence, and relevant international standards. This official Mexican characterization provides context, but the panel report remains the primary source for what the panel decided. The ministries’ communication records Mexico’s position.

The trade figures behind the dispute

U.S. corn exports to Mexico were valued at $4.8 billion from January through October 2024, according to USTR. USTR later reported $5.6 billion for calendar year 2024. These figures cover different periods—the first is ten months, the second the full year—and should not be read as like-for-like measures of a change caused by the ruling. The export totals show the scale of trade, but do not quantify the ruling’s effects on health, biodiversity, yields, or economic outcomes. USTR’s 2024 announcement gives the January–October figure; its 2025 statement reports the full-year value.
