In U.S. residential renting, “lease” and “rental agreement” can describe the same contract. The title alone does not tell you whether your tenancy is fixed-term or month-to-month. Check the document’s term, renewal, rent, and termination clauses—and consult your state’s rules for their legal effect.
Are a lease and a rental agreement the same thing?
Often, yes. The labels overlap in ordinary U.S. residential renting, so there is no reliable nationwide rule that a document called a “lease” must be fixed-term or that a “rental agreement” must be month-to-month. HUD’s sample form is explicitly titled “Basic Rental Agreement or Residential Lease” and uses both terms.
HUD housing counselor training describes a written lease as a document setting out rental terms, while noting that oral agreements are recognized and enforced in many states. That is general context, not a rule for every location; do not assume an oral arrangement is enforceable or has particular terms without checking local law. HUD’s training module discusses these distinctions.
What matters more: the title or the tenancy period?
The tenancy period is often the practical distinction renters are trying to identify. A fixed-term tenancy has a stated duration or end date; a periodic tenancy continues in recurring periods, such as month to month. HUD training describes a fixed-term contractual tenancy, and its sample form illustrates a stated end date as well as a month-to-month option.

Read the clauses that establish the period and explain what happens when it ends. A stated end date, an automatic renewal clause, and a provision for continuing month to month can produce different outcomes even when documents have similar titles.

When reviewing a lease or rental agreement—or comparing two versions—look for the actual terms that affect your costs and obligations:

- Term: Is there a fixed end date, or does the tenancy continue by recurring periods?
- Renewal or continuation: Does the agreement renew automatically, require a new agreement, or shift to a periodic tenancy?
- Notice and termination: What notice does the document require, and what conditions apply? The legal effect of notice requirements depends on state and local law.
- Rent and payment: Check the amount, due date, payment method, and any stated fees. HUD’s sample includes rent and payment-timing terms.
- Deposit and other responsibilities: Review deposit details, utilities, maintenance, and other provisions that apply to your situation.
- Addenda: Identify attachments and check whether any addendum controls if its terms conflict with the main agreement.
HUD’s sample form illustrates common fields including the term, rent, payment timing, and deposit. It is an example, not a substitute for reading the agreement that applies to your home.
Can an addendum override the main agreement?
Sometimes, depending on the program and applicable rules. For the Housing Choice Voucher program, HUD says the required tenancy addendum is attached to the landlord’s lease and prevails over conflicting lease language. Which rules determine your rights?
Tenant rights are governed by state law, and the legal effect of a lease clause can also depend on local requirements. HUD directs renters to consider the rules that apply in their state; USAGov likewise directs people to state tenant-rights resources. For a location-specific answer, start with your state’s housing or tenant-rights agency and review the applicable local rules. HUD’s tenant-rights guidance and USAGov’s tenant-rights page provide starting points.
