The settlement is not a finding that TikTok was liable, and the government did not establish “spying” as a legal finding. The amount also should not be described as a record without qualification: DOJ called it one of the largest recoveries under the Children’s Online Privacy Protection Act (COPPA), while the FTC described a separate 2019 Musical.ly penalty as the largest it had obtained in a children’s privacy case at that time.
What did TikTok allegedly do?
The FTC and DOJ’s 2024 complaint alleged that children under 13 used regular TikTok accounts despite the app’s age screening, and that TikTok collected their personal information without giving parents notice or obtaining the consent COPPA requires. The complaint also raised allegations about advertising, TikTok’s Kids Mode, profiling, and failures to honor some requests to delete children’s information. These were allegations in the complaint, not findings after trial. The agencies’ complaint and announcement are available from the FTC and DOJ.
The complaint said TikTok had more than 170 million U.S. users in 2024. It also cited survey figures as context for the app’s reach: two-thirds of U.S. teens reported using TikTok in 2022, and nearly half said they used it multiple times a day by late 2023. Those figures describe the complaint’s context, not findings made in the settlement.
Was TikTok fined, and was it a record?
DOJ announced a $400 million settlement on August 21, 2026. Under its terms, $300 million is payable immediately and a further $100 million is conditional on entry of an order vacating the Musical.ly consent decree. DOJ said the claims resolved were allegations only and that there had been no determination of liability. It characterized the recovery as one of the largest under COPPA, not as a record. The comparison with the earlier case helps explain the “record” wording:

The $400 million settlement is much larger in dollar terms than the 2019 amount, but that does not make “record fine” an accurate description of the 2026 outcome. DOJ described the 2026 resolution as a settlement and explicitly said liability was not determined; its public characterization was “one of the largest,” not “the largest.”

What does COPPA protect?
COPPA is a U.S. federal law governing the collection of personal information from children under 13 by child-directed online services and by general-audience services that know they are collecting such information. FTC guidance says covered services must give parents notice and obtain verifiable parental consent before collecting, using, or disclosing a child’s personal information. The FTC’s children’s privacy guidance explains the requirements.
Parents have rights under the rules as well: they may review information collected from their child, withdraw consent, and request deletion. COPPA’s under-13 threshold is specific; it does not mean that every privacy concern involving a teenager is automatically a COPPA violation.

What can parents do?
- Use available account and privacy controls. Review the child’s account settings and the service’s options for limiting collection, use, sharing, and visibility.
- Ask to review or delete a child’s information. FTC guidance says parents can request access to information collected from a child, withdraw consent, and seek deletion where COPPA applies.
- Report suspected COPPA violations. The FTC directs consumers to ReportFraud.ftc.gov. A report is not itself a finding that a company broke the law.
These steps can help parents exercise privacy rights, but the TikTok settlement itself does not determine liability for the allegations in the complaint.
