Some Fireball mini bottles sold at gas stations contain a malt-based or wine-based cinnamon drink, not Fireball Cinnamon Whisky. Check the front label: Fireball says “Cinnamon Whisky” identifies its whisky-based product, while “Cinnamon” without “Whisky” identifies a malt- or wine-based version. A 50 mL mini can be either one, so the bottle size alone does not tell you what you’re buying.
How to tell which Fireball is in the bottle
Look at the front-label wording first, then confirm the product description and alcohol content. Fireball’s product FAQ says a package labeled “Cinnamon Whisky” is its whisky-based product. A package labeled “Cinnamon” without “Whisky” is a malt- or wine-based beverage.
- “Cinnamon Whisky”: whisky-based Fireball Cinnamon Whisky.
- “Cinnamon” without “Whisky”: Fireball Cinnamon, which is malt-based or wine-based.
Do not rely on the word “Fireball,” the cinnamon flavor, or the small bottle size as a substitute for reading the label. Fireball says its whisky-based product is also sold in 50 mL minis.
How the three products differ
| Product | Base | Strength listed by Fireball | Label and sales channel described by Fireball |
|---|---|---|---|
| Fireball Cinnamon Whisky | Whisky-based | 66 proof (33% ABV) | Front label says “Cinnamon Whisky”; listed in 50 mL size and sold through bars, restaurants, and liquor stores. |
| Fireball Cinnamon malt-based beverage | Malt-based | 33 proof (16.5% ABV) | Front label says “Cinnamon” without “Whisky”; may be sold in beer, malt-beverage, and wine stores. |
| Fireball Cinnamon wine-based beverage | Wine-based | 42 proof (21% ABV) | Front label says “Cinnamon” without “Whisky”; may be sold in beer, malt-beverage, and wine stores. |
These identities, strengths, sizes, and channels are described by Fireball. The proof and ABV figures are the brand’s stated product information, not a test of an individual bottle.

Why a gas station may sell Fireball Cinnamon
Alcohol retailers are subject to state and local licensing rules, and stores that can sell beer, malt beverages, or wine may not be licensed to sell whisky. Fireball says it developed malt- and wine-based versions for retail channels where whisky cannot be sold. The company says these products are available in approximately 170,000 U.S. stores; that is Fireball’s own estimate, and its FAQ does not state a publication year.
The federal labeling framework helps explain why the distinction matters. The Alcohol and Tobacco Tax and Trade Bureau says malt-beverage labels and advertising must not create a false or misleading impression that the beverage contains distilled spirits or is itself a distilled-spirit product. The agency also says a distilled-spirit brand name may be used on a malt beverage when the overall label or advertisement is not misleading. This is general guidance, not a TTB finding about any particular Fireball package. See the TTB labeling FAQ.

What the Fireball lawsuits do—and do not—establish
Packaging similarity between the whisky and malt versions has been challenged in court, but procedural decisions should not be mistaken for a final finding that Fireball or its maker broke the law.
California order in 2023
On May 17, 2023, the U.S. District Court for the Northern District of California denied Sazerac’s motion to dismiss a consumer complaint about Fireball Malt mini packaging. At that stage, the court concluded that allegations about similar packaging, small-print disclosures, and the overall label could plausibly support consumer confusion. It did not decide that Sazerac was liable or that the label was unlawful. The order is available through the court record.

Florida opinion in 2024
A 2024 opinion from the U.S. District Court for the Middle District of Florida also addressed allegations involving similarities in whisky and malt packaging and retail presentation. It was a procedural ruling on the claims before that court, not a final factual finding about all consumers or all Fireball products. See the Florida opinion.
In a separate case, the plaintiffs voluntarily dismissed the Marquez proposed class action on May 19, 2023. That case-specific dismissal does not establish the outcome or current status of other related cases. The disposition is recorded in the case docket.
