The dependent care FSA limit for tax year 2026 is $7,500, or $3,750 for a married individual filing separately. A dependent care FSA is an employer benefit, and eligible expenses generally must pay for care that enables you—and, if applicable, your spouse—to work or look for work. Benefits excluded from income reduce the expenses available for the child and dependent care credit, so the same costs cannot be counted twice.
What is the dependent care FSA limit for 2026?
The IRS’s 2026 Publication 15-B sets the annual dependent-care exclusion limit at $7,500 for tax year 2026. For a married individual filing separately, the limit is $3,750. The IRS says these amounts increased from $5,000 and $2,500, respectively.
This is the federal exclusion limit, not a promise that every employer plan lets employees contribute that amount. Your employer must offer a qualifying plan, and its written terms govern enrollment and reimbursement procedures. Check the plan documents and administrator’s instructions before choosing an election.
What expenses are eligible for a dependent care FSA?
Eligibility depends on the person receiving care, why the care is needed, the tax-year rules, and your employer plan. The IRS’s detailed Publication 503 for 2025 returns and 2025 Form 2441 instructions describe the federal rules below. Do not treat those 2025 materials as a substitute for current-year instructions or your plan’s reimbursement rules.

Qualifying people
Under the 2025 return guidance, a qualifying person generally includes:
- Your dependent child who was under age 13 when care was provided.
- Your spouse, if unable to care for themselves and living with you for more than half the year.
- Another person unable to care for themselves who meets the dependency and residence tests.
Special rules can apply, including when parents are separated, a child turns 13 during the year, or a dependent has a disability. Consult the applicable Form 2441 instructions for those circumstances.

Work-related care expenses
Generally, care must enable you—and your spouse, if applicable—to work or look for work. Different rules apply in some cases, including for a full-time student or a person unable to care for themselves. The care must also be for the qualifying person’s well-being and protection.
The 2025 Form 2441 instructions include qualifying care outside the home for a dependent under 13 and day camps, including camps focused on particular activities. They exclude expenses such as kindergarten or higher-grade schooling, overnight camps, summer school, and tutoring programs. Whether a particular charge qualifies for reimbursement also depends on your plan.

Does a dependent care FSA cover summer camp?
A day camp may qualify under the 2025 federal rules when it meets the work-related care requirements; an overnight camp does not qualify under those instructions. A camp’s educational or tutoring charges may be treated differently from care. Verify the expense with your plan administrator before submitting it.
School and before- or after-school care
The IRS distinguishes education from care: kindergarten tuition is an educational expense and does not qualify for the child and dependent care credit, while before- or after-school care may qualify. The distinction is described in the IRS’s child and dependent care credit FAQ. Check your plan’s terms as well as the federal tax rules.

Can you use a dependent care FSA and claim the child and dependent care credit?
You may be able to use both in a tax year, but not to claim the same expenses twice. Excluded employer dependent-care benefits—including pre-tax dependent-care FSA contributions—reduce the amount of work-related expenses available for the child and dependent care credit.
For 2025 returns, Publication 503 gives general credit expense limits of $3,000 for one qualifying person and $6,000 for two or more. Excluded benefits reduce the applicable limit. For example, with two or more qualifying people and $5,000 of excluded benefits, $1,000 remains under the general $6,000 expense limit. These are 2025 credit figures, not 2026 limits.

Whether an FSA election or the credit is more advantageous depends on your tax year, filing status, household income and earned income, number and status of qualifying people, eligible expenses, and employer plan terms. Compare your circumstances using the applicable tax-year rules rather than assuming one approach is always better.

If you receive dependent-care benefits, the IRS’s 2025 Form 2441 instructions say to use Form 2441 to determine how much, if any, can be excluded from income. Complete Part III before calculating any credit in Part II. The applicable current-year form instructions should guide your filing.
Employee dependent-care benefits are reported in box 10 of Form W-2, according to the IRS FAQ. Benefits above the allowable exclusion may be included in box 1 wages. Use the information on your W-2 and the current-year Form 2441 instructions to report the amounts correctly; do not rely on an outdated FAQ dollar limit.
Records to keep
Keep the plan materials and records that support your claim, including provider identifying information, dates of care, invoices or receipts, and reimbursement records. Follow your administrator’s submission instructions and applicable tax recordkeeping guidance. A single receipt-retention period does not apply to every plan based on the cited IRS materials.
