It can matter to which interest-rate rules apply, but it does not tell you your card’s APR or, by itself, remove federal consumer protections. For your account’s actual terms, identify the issuing bank and read your cardholder agreement.
First identify the bank that issued the card
The name or logo on a card may belong to a retailer, airline, or other brand rather than the bank that issued the credit. The Consumer Financial Protection Bureau (CFPB) notes that the entity named on the front may not be the actual issuer. Check the back of the card, your latest statement, or the card brand’s website to find the bank.
The charter belongs to that issuing bank—not to the Visa, Mastercard, American Express, or Discover payment network, and not necessarily to the brand featured on the card.
What the charter tells you about supervision
A charter is the legal basis under which a bank operates. It helps identify the institution’s primary supervisory framework; it does not, on its own, determine an individual card’s price or settle a dispute.

Why a charter can matter to interest rates
National-bank interest-rate authority can connect the rate a bank may charge to the law of the state where the bank is located. The OCC’s Comptroller’s Handbook describes this framework—commonly called interest-rate exportation—in connection with 12 U.S.C. § 85. This is a legal framework, not a shortcut for calculating a particular card’s rate. National-bank status does not mean a bank can charge any rate in every situation, nor does it establish that a specific rate is lawful. The issuer’s location, the account agreement, the applicable law, and the facts all matter.

Federal consumer-credit rules apply according to their scope and requirements, not simply according to a bank’s charter. The CFPB’s Regulation Z interpretation says qualifying consumer credit extended to U.S. residents is generally covered whether the lender is chartered or based in the United States or abroad. Regulation Z, 12 CFR § 1026.1

The Equal Credit Opportunity Act also bars discrimination on specified protected grounds in decisions to extend credit or set terms. It does not guarantee that every applicant will be approved; applicants must still meet the issuer’s credit standards. CFPB: What is the Equal Credit Opportunity Act? Which protections apply to a particular account or dispute depends on the law’s coverage and the circumstances.

How to check your card’s terms and find the right regulator
- Find the issuing bank. Check the back of the card, your most recent monthly statement, or the card brand’s website rather than relying on the prominent logo.
- Read your account agreement. Use the agreement for your card to confirm your APR, fees, and other account terms. If you need a copy, ask the issuer to provide it.
- Use the CFPB database as a starting point. The CFPB publishes credit-card agreements submitted by hundreds of issuers, with general terms, pricing, and fee information. Database entries may not include every account-specific detail or reflect every discrepancy or omission, so they are not a substitute for your own agreement. CFPB credit card agreement database
- Choose a complaint route based on the issuer. The OCC accepts complaints involving national banks. For state banks, the CFPB, the state banking department, the FDIC, or the Federal Reserve may be appropriate depending on the institution. The OCC directs customers to identify the relevant agency and links to the FDIC Institution Directory for information about a bank’s primary supervisors. OCC: HelpWithMyBank
- Keep useful records together. Have your statement, cardholder agreement, relevant dates and amounts, and any correspondence available when contacting the bank or filing a complaint.
