Why did Zynga owe IBM money?
IBM sued Zynga and advertising-technology company Chartboost in Delaware in 2022 over several patents. In the verdict referenced by the court’s September 24, 2024 partial judgment, the jury found Zynga infringed claims 8 and 13 of U.S. Patent 7,072,849. The judgment also found the infringement willful and rejected Zynga’s invalidity defenses. It awarded $40 million in damages, with interest and costs to be fixed separately. The partial judgment records the court’s findings and award.
That is the legal basis for the headline’s “$45M” shorthand: contemporaneous news reports described the jury award as $44.9 million or nearly $45 million. The court-entered damages figure was $40 million. Neither figure should be mistaken for a confirmed final settlement amount.
Which games were named in the judgment?
The judgment identified ten games as infringing Patent 7,072,849:

Bloomberg Law separately reported that Empires & Puzzles also infringed U.S. Patent 7,702,719. That does not mean the jury found every game infringed every patent IBM had asserted during the broader dispute.
What was the 1980s patent technology?
Ars Technica described Patent 7,072,849 as stemming from technology IBM developed for its Prodigy online service in the 1980s. IBM’s account of the method was that applications and advertisements could be assembled from objects stored on a user’s computer, reducing the amount of information that needed to be sent from host servers over a network. The jury’s finding concerned specific claims of this patent and the named games; it was not a general finding that all mobile games use infringing technology.

IBM also asserted Patent 7,702,719, which Ars described as addressing application performance by reducing client-server interactions and network delays. The specific verdict and partial judgment findings should be kept distinct from IBM’s earlier, broader allegations.
Does the case mean Zynga games must change or shut down?
Not according to Zynga’s reported position after the verdict. Ars Technica said Zynga told investors the patents had expired and that the games would not have to be modified or discontinued; the company also said it intended to challenge the result. Those were Zynga’s statements, not a court ruling that the games were permanently cleared of any future consequences.

Ars also quoted a Take-Two spokesperson saying the company was disappointed in the verdict but believed it would prevail on appeal. That statement likewise expressed the company’s position, not the outcome of an appeal.
What happened after the jury verdict?
- 2014: Ars reported that IBM said it first alerted Zynga to alleged infringement.
- 2022: IBM brought the case in Delaware against Zynga and Chartboost.
- September 13, 2024: Date of the jury verdict cited in the judgment.
- September 24, 2024: The court entered partial judgment finding willful infringement of Patent 7,072,849 and awarding $40 million in damages, with interest and costs still to be determined.
- December 17, 2024: Bloomberg Law reported that the parties were finalizing a settlement and court deadlines had been paused. That report did not establish the final settlement amount or final disposition.
Bloomberg Law’s December 2024 report is the latest status established here; it is not enough to say that a settlement was ultimately completed or to quote a final payment figure.
