Prediction Markets vs. Sports Betting: Key Differences in Contracts, Risk, and Regulation

Prediction markets trade event contracts; sportsbooks accept wagers under their odds and rules. Here’s how pricing, risk, settlement, and U.S. oversight differ.

Prediction markets and sportsbooks can both let you take a position on a sports outcome, but they do not necessarily sell the same thing. A prediction market commonly offers a defined event contract that trades at a market price and settles under written contract rules; a sportsbook accepts a wager under its odds and house rules. The distinction affects pricing, exits, settlement, and oversight—but calling an app a prediction market does not by itself settle whether a sports contract is lawful in your state.

What you buy: an event contract or a wager

Prediction markets use defined event contracts

A prediction-market position is commonly an event contract: a trade tied to a specified event, with a price, payout, expiration, and settlement method. Many are framed as yes/no questions. The Commodity Futures Trading Commission (CFTC) describes event contracts as typically structured as swaps and often providing a fixed payout, usually $1, if the specified outcome occurs.

For example, in the CFTC’s rain-contract illustration, a yes position costs 70 cents and a no position costs 30 cents. If it rains, the yes holder receives the stated $1 settlement payout. Before fees and taxes, that buyer’s gross profit is 30 cents—not $1, because the purchase price is a cost. If the event resolves no, the yes position loses its investment. The contract’s own terms determine what counts as rain and how the result is settled.

Not every contract is a single yes/no question. Markets can offer multiple-choice outcomes, combine several questions, or pay different amounts across outcome ranges. More complex contracts may attract fewer participants and have lower liquidity, according to the CFTC.

Sportsbooks accept bets under their offered terms

A conventional sportsbook presents odds and a potential payout for a wager it accepts. The bettor’s position is governed by that sportsbook’s accepted wager terms and house rules. Operators need not use identical formats or rules, so compare the specific bet and contract rather than assuming every sportsbook or event-contract platform works the same way.

How price, payout, and settlement differ

What determines the price? A market price formed through trading; it can move as bids and asks change. It may be read as a market-implied probability, but it is not a guarantee or a direct measure of the chance the event will occur. The sportsbook offers odds and a payout under the accepted wager terms. The CFTC material does not establish one pricing method used by all sportsbooks.
Can you exit early? A trader may be able to sell before expiration at the then-current market price. An exit depends on an available market and a willing counterparty; neither execution nor a particular price is guaranteed. The supplied CFTC guidance does not establish a general early-exit mechanism for sportsbook bets. Check the operator’s rules for the wager.
What controls resolution? The contract’s event definition, resolution source, deadline, cancellation provisions, and settlement rules. The accepted wager terms and sportsbook rules, including how the operator treats cancellations or other specified circumstances.
What can go wrong financially? A wrong position can lose the amount invested. A correct outcome may still fail to produce a net profit after entry price, fees, taxes, and any exit price are accounted for. The bettor’s return depends on the accepted odds, stake, and wager terms. No universal side-by-side fee or net-return comparison is established by the CFTC materials cited here.

The CFTC says customers on regulated markets are entitled to transparent contract terms, including how settlement determinations are made. That does not make every event definition intuitive: read the exact language, especially where a game is postponed, abandoned, disputed, or resolved using a particular data source. A market price can reflect participants’ views, but your own result depends on the price at which you enter or exit and on the contract’s settlement.

What the risks look like in practice

A market price is not the same as your profit

For a fixed-payout contract, the price you pay matters. Buying a yes contract for 70 cents that later pays $1 yields 30 cents in gross profit before fees and taxes; buying it for 95 cents and receiving the same $1 yields only 5 cents before those costs. If your total costs exceed your gross return, a correct prediction can still leave you with a net loss. Any early sale also replaces the possible settlement payout with the price available when you exit.

Liquidity affects the ability to trade out

Liquidity is the availability of buyers and sellers at prices near the current market. A thin market can make it harder to sell at the price you want, especially in a complex contract with comparatively few participants. The CFTC says traders may exit before settlement at current market prices; that is a possibility, not a promise that every contract will have an active exit market.

Neither format is inherently safer or more profitable

An event contract can be used to speculate or to hedge an economic exposure. The CFTC gives the example of a citrus farmer using a weather contract to offset potential freeze losses. That illustrates a possible use of event contracts; it does not show that a sports contract will effectively hedge a particular person’s financial exposure. A market structure does not remove the risk of losing the amount invested, and the available CFTC materials do not establish that prediction markets are inherently safer, more accurate, cheaper, or more profitable than sportsbooks.

Who oversees them—and why sports contracts are contested

CFTC-regulated markets have derivatives-market obligations

The CFTC describes registered exchanges and intermediaries as subject to an application process, periodic examinations, market-integrity rules, and surveillance. Futures commission merchants that intermediate trades must comply with customer-protection requirements, including rules designed to protect customer funds. Those protections depend on the entity and trade structure; check the particular operator’s registration, intermediaries, customer-fund arrangements, and account terms rather than inferring them from an app’s branding.

State-regulated sports betting operates under state-specific gaming frameworks. Whether a sports event contract offered on a prediction market falls under federal derivatives law, state gambling law, or both is the subject of active disputes. The CFTC asserts exclusive federal authority over commodity derivatives traded on regulated markets. States have challenged some sports-related offerings under gambling laws. These are competing legal positions, not a settled nationwide answer based simply on the product’s label.

Agency proposals and litigation positions are not final court rulings

A 2026 CFTC proposed rule discusses statutory categories under which the agency may determine that certain event contracts are contrary to the public interest, and seeks comment on how “gaming” should be interpreted, including whether sports contests should be treated differently from other competitions. It is a proposal, not a final rule.

In a February 17, 2026 release, the CFTC said it filed an amicus brief in Ninth Circuit litigation involving Nevada and asserted exclusive jurisdiction over commodity derivatives, including event-contract markets. In an April 2, 2026 release, the agency said it sued Connecticut, Arizona, and Illinois over state actions and described its view that federal derivatives law governs. Those releases state the agency’s litigation position; they do not establish that a court has resolved the issue for every state or platform. The agency’s 2025 roundtable announcement also identified questions involving sports-related contracts, gaming, preemption, state rights, and tribal sovereignty. As of October 7, 2026, the cited official materials do not establish a final nationwide judicial resolution.

The legal classification does not follow solely from the word “prediction market.” Availability and legal treatment may vary by product and jurisdiction and can change as litigation and rulemaking proceed. This comparison is general information, not a determination that a particular contract is legal or available where you live.

What the market’s growth figures do—and do not—show

The CFTC’s 2026 proposed rule reports approximately five event contracts listed per year on designated contract markets from 2006 through 2020, 131 contracts listed in 2021, and approximately 1,600 contracts certified for listing in 2025. The proposal says the 2025 offerings covered areas including financial indices, economic indicators, weather, politics, international affairs, science and culture, current events, and sports. These are contract-count figures, not counts of trades, users, trading volume, or forecast accuracy.

The CFTC says prediction markets can sometimes forecast outcomes better than polling or other forms of forecasting, and notes that market forecasts are increasingly cited by media and analysts. Its consumer explanation does not supply a named study or quantified head-to-head result. That claim should therefore be understood as a limited agency statement, not evidence that any particular market or sports contract predicts outcomes more accurately.

For historical context, the CFTC says U.S. prediction markets date to 1988, that it began regulating them in 2004, and that it first recognized the Iowa Electronic Markets in 1992. Those milestones describe the agency’s account of the market’s history; they do not determine the status of a current sports offering.

Checklist before taking a position

Read the contract and operator materials before committing money. The CFTC says customers should receive clear information about risks and costs, timely contract terms, accurate statements, and access to funds. Check:

  • Operator and registration: Confirm the entity’s registration and use its official app or site; do not treat a product label as proof of regulatory status.
  • Event definition: Identify precisely what outcome the contract asks about, including the relevant team, game, time period, or condition.
  • Resolution: Find the settlement source, decision process, deadline, and rules for postponements, cancellations, or other unusual outcomes.
  • Economics: Check the entry price, stated payout, expiration, commissions, fees, taxes, and any other costs.
  • Exit and liquidity: Determine whether an early-exit market exists and whether it has enough trading interest to make an exit at a reasonable price plausible.
  • Funds and account terms: Review customer-fund arrangements, withdrawal conditions, and the operator’s account terms.

For an event contract, the written contract rules control the resolution. For a sportsbook bet, the accepted wager terms and house rules control. If either set of terms is unclear, do not assume that ordinary meanings or another operator’s practices will decide the outcome.
