Start with the exchange’s legal entity and the service you plan to use: spot trading, securities brokerage, investment advice, or derivatives. Then check the matching official database—BrokerCheck or Investor.gov, SEC IAPD, or NFA BASIC—and compare the record with the exchange’s domain and disclosures.
Which regulator lookup should you use?
The right database depends on what the company does, not simply on whether it calls itself a crypto exchange. A platform may use different legal entities for different products, so identify the entity named in the relevant terms or customer agreement.

Is a crypto exchange registered with the CFTC if it only offers spot trading?
Not necessarily. The CFTC says that a company offering customers the ability to buy or trade virtual currencies on the cash or spot market is not required to register with the CFTC solely for that activity. That does not mean every activity on the platform is outside federal regulation: intermediaries advising on or facilitating virtual-currency commodity futures must register with the CFTC and NFA, and the CFTC retains anti-fraud and anti-manipulation authority over virtual-currency spot markets. Classify the specific product before treating a missing record as meaningful. Spot purchases, securities trading, futures, options, swaps, and individualized investment advice can point to different requirements and lookups. A single search cannot establish that every product or service offered under a brand is covered.
How do I check whether a crypto exchange is registered?
- Identify the counterparty. Record the website domain, app publisher, legal company name, jurisdiction, and any subsidiaries listed in the applicable terms, custody disclosures, or site footer. A brand may be operated by more than one entity.
- Classify the service. Determine whether you are checking spot crypto, securities brokerage, derivatives, or investment advice. Use the database that corresponds to that activity.
- Search the official record. Use BrokerCheck or Investor.gov for broker-dealers and professionals, SEC IAPD for investment advisers, and NFA BASIC for CFTC-regulated intermediaries.
- Open and compare the record. Check the exact legal name, address, website, registration category and current status, and the relationship between the firm and any person promoting or handling the service. Read disclosures and relevant forms rather than relying on a search-result snippet.
- Resolve mismatches or no results. Ask the exchange for the legal entity name, the registration category it claims, and the regulator record supporting that claim. A CFTC BASIC search may not show an entity that is exempt or not regulated by the CFTC; the CFTC advises consumers to ask the firm why it is not listed.
- Check for impersonation and warnings. Search SEC PAUSE for known false registration claims, then independently verify that the domain and contact details belong to the entity in the official record. PAUSE is not a complete list of unregistered entities or impersonators, and scammers may copy details from a genuine firm.
Why can’t I find my crypto exchange on NFA BASIC?
A missing BASIC result does not, on its own, prove that an exchange is illegal or that it should be registered with the CFTC. The company may use another legal name or affiliate, offer only spot trading, qualify for an exemption, or provide a service outside the registration category you searched. The CFTC’s guidance distinguishes spot-market businesses from intermediaries involved in virtual-currency commodity futures and recommends asking an absent firm to explain its status. Start by confirming the exact legal entity and product, then check the regulator appropriate to that service.

Does FinCEN registration mean an exchange is approved?
No. FinCEN’s MSB Registrant Search and NMLS can help with separate money-services and applicable state licensing checks, but those are not SEC or CFTC registration databases. FinCEN registration is not approval or endorsement of a business. The CFTC points consumers to these resources as adjacent checks, not substitutes for checking the registration relevant to a particular product. See CFTC consumer guidance.

A matching entry shows that the named person or entity appears in that database under a stated category and status. It does not establish that every part of a brand’s business is covered, that the government endorses the platform, or that customers are insured or guaranteed to recover losses. The CFTC warns that registration and a clean disciplinary record do not protect consumers from fraud.

Likewise, a search with no result is a reason to investigate, not an instant legal conclusion. Names, affiliates, product types, exemptions, non-U.S. status, or the absence of a registration requirement for a particular activity can affect what appears. If the exchange will not disclose its legal entity, pressures you to act, claims government endorsement, or provides contact details inconsistent with official records, pause and verify independently. SEC PAUSE can identify some warnings, but a clean result there is not clearance.
