How GST Rate Changes Are Recommended and Approved in India

The GST Council recommends rate changes, but the applicable rate changes through a government notification. Here is how the process works and what to check.

In India, the GST Council recommends changes to GST rates; the recommendation itself does not automatically change the rate payable. The relevant government notification gives a change legal effect, so check its text and commencement clause to find the rate and date that apply to a particular good or service.

Who recommends GST rate changes?

The GST Council is the constitutional body that recommends GST rates to the Union and the States. Article 279A(4), reproduced on the Council’s official website, says the Council makes recommendations on GST-related matters including goods and services subject to or exempt from GST and “GST rates including the floor rates with bands.”

The Council’s role is recommendatory. To determine what a business or consumer must use for a specific transaction, distinguish the Council’s recommendation from the subsequent legal instrument that implements it.

How does a rate proposal move through the Council?

The Council’s procedural agenda document describes a route for proposals seeking a recommendation. These are the steps stated in that document; they should not be taken as proof that every proposal must follow an identical timetable or analytical process.

  1. A member submits a written proposal. Under the procedure, any Council member may send a proposal to the Secretary. It should include background, the constitutional provision relied on, a justification, and the specific points on which the Council is asked to decide.
  2. The proposal is circulated and considered for the agenda. The Secretary obtains the Chairman’s approval to circulate it to Council members, collects and tabulates their comments, and seeks approval to place it on the agenda. The document says a meeting is duly constituted when chaired by the Chairman with at least half of Council members present.
  3. Members deliberate and may vote. Members discuss the matter; when a question is put, the procedure provides for voting. The constitutional voting rules are described below.
  4. The Council makes a recommendation. The outcome may be communicated through meeting materials or press documents. The official document for the 56th GST Council meeting, for example, includes HSN-wise and sector-wise annexures setting out recommendations.
  5. Government action implements the recommendation. The relevant notification—not the recommendation alone—must be checked to establish the legally applicable change and its start date.

The procedural steps above are stated in the Council’s official procedural agenda document. The Council’s rate-notification index lists central tax-rate notifications as instruments implementing recommendations. That central index is not a substitute for checking every relevant instrument or jurisdiction.

How are votes weighted?

Article 279A assigns one-third of the total weighted votes cast to the Centre and two-thirds collectively to the States. A proposal carries when at least three-fourths of the weighted votes cast by members present and voting are in favour. These are constitutional voting rules, not estimates from a statistical study.

What analysis may inform a proposal?

Official historical agenda material records the Fitment Committee examining rate representations and, in that example, assessing pre-GST tax incidence using elements such as prior excise duty and VAT before the Council deliberated on committee recommendations. This shows one documented analytical route; it does not establish a universal formula or that committee review is required for every proposal. The available official material also does not establish a standard timetable for rate proposals.

How to check whether a new rate applies

Do not rely on a headline or Council announcement alone when deciding which GST rate to charge or pay. Verify the legal instrument and the details that determine whether it covers the transaction:

  • Notification status: establish whether a recommendation has been followed by an implementing notification.
  • Jurisdiction and tax type: identify the relevant central, state, or integrated-tax instrument. A central notification index alone may not show every instrument that matters.
  • Classification: match the exact goods or service and its HSN or other applicable classification to the notification’s schedule entry.
  • Effective date: read the notification’s commencement language and confirm its publication in the Gazette. The operative date comes from the legal instrument, not simply the date a recommendation was announced.

For a specific change, consult the actual Gazette notification and its commencement clause. The Council’s official rate-notification index can help locate central rate notifications, but check any other relevant instrument as well.
