Before acting, work out what the signal measures, identify the instrument and the losses it can expose you to, and check the project’s upgrade information alongside the policies of the exchange, custodian or product you use. No universal timing, position-size or stop-loss formula is established for these situations.
Can crypto market signals predict what happens next?
A signal is information to assess, not evidence of a guaranteed outcome. It might be an observed indicator, a forecast built from assumptions, or a sales claim about a tool. Those are different things. The CFTC warns that “AI technology can’t predict the future or sudden market changes” and cautions consumers about trading bots and buy-or-sell signal claims. Its customer advisory states: “There is no such thing as a guaranteed investment or trading strategy.”
Before relying on a signal, ask:
- What does it measure? Identify the underlying data and whether the signal reflects a price, volume, network event or other input.
- What is its time horizon? A signal framed around a short-term move may not address a longer-term investment question, and vice versa.
- What assumptions does it make? Check whether its logic depends on market conditions that may change, or on data that may be incomplete or delayed.
- Who benefits if you act? Look for sales incentives, referral arrangements or other conflicts. Extraordinary or guaranteed-return claims are warning signs, not proof of an edge.
- What evidence supports it? Do not assume a signal is reliable, tested or profitable unless independent evidence supports that specific claim. Past examples or a bot’s advertised results do not establish what it will do in a different market.
What kind of exposure are you taking?
“Trading crypto” can mean holding a token, trading a margined futures contract, or buying a fund that obtains exposure through futures. These are not interchangeable: the instrument determines what you own or owe, how losses can occur, and which platform or service-provider policies matter.

The CFTC warns that virtual-currency cash markets can involve volatile swings, flash crashes, manipulation, cyber risks and platforms with limited safeguards. For futures, leverage magnifies price moves. The CFTC says customers may have to add margin or have positions closed, and losses can exceed the initial investment. The amount and consequences depend on the contract and provider; there is no generally suitable leverage level established for all traders.

What should you check before a network upgrade?
An upgrade is an operational event as well as a possible source of market attention. The CFTC identifies technology changes and forks, along with liquidity, future demand and hacking, as factors that can affect virtual-currency value. That does not establish that an upgrade will raise or lower a token’s price. Check the actual network and the specific service you use rather than assuming every project or venue handles an event the same way.
- Read the project’s official upgrade documentation. Find the proposal or release information, activation conditions and timing. Note any required client or software versions and the risks the project identifies.
- Check your exchange or trading venue’s notice. Look specifically for its event policy on deposits, withdrawals and trading, including whether it plans any pauses. Do not assume a venue follows the network’s schedule exactly.
- Check the relevant wallet or custodian. Confirm whether it supports the network change and what steps, if any, it requires. A venue’s policy does not automatically describe a separate wallet or custodian’s policy.
- For a fund or other product, read the product’s own disclosure. Look for how it addresses network changes, forks and any related assets, as well as who makes relevant decisions.
- Reassess whether the exposure still matches your purpose. Consider operational access, potential liquidity changes and the possibility that market participants respond differently than expected. Event timing alone cannot establish a price direction.
SEC staff has described crypto exchange-traded product disclosures that may discuss network characteristics, changes to a network, and issuer policies for forks and airdrops. Those disclosures are product-specific; they do not establish one policy for all issuers or all assets.

How can you compare spot ownership with a futures-based product?
Compare the actual rights and dependencies, not just a product name or a headline price chart. The SEC staff statement describes disclosures that may address indexes, net asset value, network characteristics, forks and risks. A joint SEC/CFTC investor alert explains why a futures-based product’s performance can differ from spot: futures prices and delivery months may differ, contracts expire, and positions are rolled into later contracts.
- Underlying asset and network: Identify which asset and network the exposure relates to, including relevant network characteristics.
- Instrument and rights held: Establish whether you would own a token, a futures contract, or an interest in a fund. Do not assume a fund interest carries the same rights as holding the asset.
- Benchmark and valuation: Read how an index or benchmark is constructed and how the product calculates net asset value.
- Liquidity and dependencies: Consider how trading, custody and other service providers affect access and valuation.
- Fees and disclosed risks: Use the product’s current disclosure to understand its costs and stated risks rather than inferring them from the underlying asset.
- Futures expiries and rolls: For futures-based exposure, account for contract expiry and the process of moving exposure to later contracts; these can contribute to returns that diverge from spot prices.
The SEC staff statement identifies itself as staff views, not a Commission rule or legally binding guidance. Product disclosures and the joint investor alert should be read within their stated scope.

How should custody, platform and fraud risks factor into a decision?
Price exposure is only part of the risk. The CFTC advises consumers to research platforms and wallets and warns there may be no assurance of recourse if virtual currency is stolen. Safeguards depend on the particular provider, product and jurisdiction. Do not describe an account, wallet or asset as protected or insured unless that claim is established for the specific arrangement.
- Find out who controls the keys or assets and what recovery process the provider describes.
- Read the provider’s terms and notices for outages, withdrawals, account access and security incidents.
- Treat promises of guaranteed returns, no risk or extraordinary bot performance as fraud warning signs.
- Do not assume that a provider’s support for an asset or upgrade means another provider supports it too.
What do U.S. regulatory statements establish—and what do they not?
The CFTC materials cited here are customer-education advisories about virtual-currency and futures risks; they do not provide a universal trading method. The SEC staff statement on crypto exchange-traded products is not itself a Commission rule or legally binding guidance. Legal classifications depend on the asset, transaction and jurisdiction, so a general risk article cannot determine the status of a particular token or trade.

On March 17, 2026, the SEC announced an interpretation concerning federal securities laws and certain crypto assets and transactions, with the CFTC joining for administration of the Commodity Exchange Act consistently with that interpretation. The announcement is not a basis for generalizing one legal result to every asset or transaction. For a specific legal question, consult current official material and qualified advice for the relevant jurisdiction.
