Its spendthrift provision generally restricts the child from transferring the trust interest and may make assets held in the trust harder for many creditors to reach before distribution. It is not a guarantee against creditors, financial hardship, or poor decisions, and the result depends on the trust document and the governing state’s law.
How a spendthrift trust works
A spendthrift trust is a trust whose terms restrict a beneficiary from assigning or transferring their interest. The trustee—not the beneficiary—administers the trust and makes distributions according to the document. Depending on those terms, the trustee may have discretion over the timing and amount of payments, or may be required to follow a stated distribution standard.
This structure can be useful when a child is not ready to manage a lump sum, has unstable finances, or may face creditor claims. It changes who controls trust assets and when they are paid out; it does not remove the child’s needs or guarantee that the assets will remain protected in every circumstance.
Trust versus an outright inheritance

These are general distinctions, not a nationwide legal result. State recognition and exceptions differ. The Uniform Trust Code is a model law, not automatically the law in every state; check the relevant state’s enacted version and amendments. The Uniform Law Commission describes the code as “a comprehensive codification of the common law on trusts” (Uniform Trust Code).

What creditor protection does—and does not—mean
A spendthrift clause can make it harder for many creditors to reach assets before the trustee distributes them, but it does not make trust property untouchable. The governing state’s law may recognize exceptions, and the beneficiary’s rights under the trust matter. Cornell Law School’s Legal Information Institute notes: “Not every state recognizes spendthrift trusts, and the ones that do differ on allowing exceptions that allow creditors to gain trust assets in certain situations.” (Cornell Law School Legal Information Institute.)
Federal tax liens
A state spendthrift provision does not automatically defeat a federal tax lien. An IRS legal memorandum explains that a lien may apply when the taxpayer has property or rights to property subject to it. The beneficiary’s actual rights under the trust are therefore important; the label “spendthrift” alone does not settle the issue. (IRS legal memorandum.)

Bankruptcy
Bankruptcy treatment also depends on enforceability under applicable nonbankruptcy law. In Patterson v. Shumate, the Supreme Court addressed the Bankruptcy Code’s exclusion for a transfer restriction enforceable under applicable nonbankruptcy law, including state spendthrift-trust law. That decision does not establish a uniform outcome for every trust or state. (Patterson v. Shumate.)
Does a spendthrift trust save taxes?
No tax reduction follows simply from calling a trust “spendthrift.” The IRS says trust tax responsibility depends on applicable tax rules, the type of trust, and the trust instrument; income tax may fall on the trust, beneficiary, or transferor. (IRS: Trusts.)

The IRS also warns against arrangements marketed as non-grantor, irrevocable, complex, or spendthrift trusts as a way to reduce or avoid taxes. That warning concerns abusive tax-evasion schemes; it does not mean ordinary estate planning with a trust is itself abusive. Trust income remains subject to the tax rules that apply to the particular arrangement. (IRS: Abusive Trust Tax Evasion Schemes.)
