The first three identified Pennsylvania recipients of Elon Musk-backed America PAC’s $1 million prizes were registered Republicans, and all had returned their mail ballots before receiving the money, according to state records reviewed by The Philadelphia Inquirer. One recipient, Kristine Fishell, also had a reported history of contributing to Republican campaigns. Those findings concern three Pennsylvania recipients; they do not establish the political profile of every recipient nationwide.

Who received the $1 million prizes?

The Philadelphia Inquirer identified the first three Pennsylvania recipients as John Dreher, Kristine Fishell and Shannon Tomei. Each had signed an America PAC petition and was publicly presented with a $1 million prize. The Inquirer reported that Musk told Dreher he would need to serve as a spokesperson for the petition.

Initial coverage described the prizes as randomly awarded. Later, in court, lawyers for America PAC said the recipients had not won a game of chance but had been selected as paid spokespeople, according to the Associated Press. The selection mechanism was therefore described differently in public reporting and in the PAC’s court account.

What is documented about the recipients’ Republican ties?

Party registration and voting history

State records reviewed by the Inquirer showed that Dreher, Fishell and Tomei were registered Republicans. The same records showed that all three had returned their mail ballots before receiving their prizes. The reporting establishes registration and ballot-return timing; it does not establish how any individual voted.

Fishell’s reported campaign contribution

The Independent separately reported, citing federal campaign-finance records, that Fishell contributed more than $500 to Republican campaigns in 2020. A campaign contribution is distinct from party registration: it documents reported financial support, not simply enrollment with a party.

What was America PAC, and what did Musk contribute?

America PAC was a pro-Donald Trump super PAC backed by Elon Musk. FactCheck.org, citing Federal Election Commission filings, reported that Musk had contributed more than $118.5 million to the group by mid-October 2024. That is a dated figure, not a total for the full election cycle.

What did courts and lawmakers say about the giveaway?

On October 25, 2024, U.S. Senators Peter Welch and Richard Blumenthal sent Attorney General Merrick Garland a letter asking the Justice Department to investigate. The senators wrote that the reward scheme “appears to violate federal campaign finance law” and stated, “There is no place for vote buying in our democracy.” Those were the senators’ allegations and advocacy, not a court’s finding.

In November 2024, a Philadelphia judge allowed the giveaway to continue through Election Day, finding that the prosecutor had not shown illegal-lottery misuse beyond speculation, the Associated Press reported. That decision concerned the Pennsylvania proceeding; it was not a general ruling resolving federal campaign-finance questions or the legality of all voter incentives.
