“AI-agent income” is not identified as a separate tax category in the Indian official materials discussed here. The tax analysis turns on what you received and what transaction took place: a fee for AI services is not automatically income from transferring a virtual digital asset (VDA) just because payment was made in crypto. A later sale or exchange of the token raises a distinct question, but the official sources do not conclusively settle how token-paid service receipts should be classified or valued.
Start with the transaction, not the fact that an AI agent was involved
An AI agent may provide a service, receive a token as a reward, or dispose of a token it already holds. Those are different events. The VDA rules concern qualifying digital assets and transactions involving them; the official sources reviewed do not identify AI-generated output or AI-service income itself as a VDA category.
The Income Tax Department’s materials describe VDAs broadly as qualifying electronically transferable information, code, numbers or tokens representing value, along with specified NFTs and other notified digital assets. The Income-tax Act, 2025 definition page likewise describes qualifying tokens or digital representations of value that can be transferred, stored or traded electronically. Whether a particular token meets the legal definition depends on its characteristics; the word “crypto” alone does not resolve that question.
How the main situations differ

When the VDA transfer rules matter
Under section 115BBH of the Income-tax Act, 1961, as described in the official material surfaced for this topic, income from transfer of a VDA is subject to a special computation: tax at 30% plus applicable surcharge and cess; deduction for cost of acquisition, but not other expenditure or allowances; and no set-off of a loss from VDA transfer against other income or carry-forward of that loss. The provision says “transfer” applies whether the VDA is a capital asset or not.

These rules do not by themselves answer whether a token paid as compensation for AI services is business or professional income, another category, or treated differently in a particular arrangement. Nor do they settle how to value the service receipt when the consideration is a token. The 30% treatment should not be applied to every AI-service fee merely because the payment involved crypto.
Withholding under section 194S is a separate question
Section 194S addresses tax deducted at source on consideration for transfer of a VDA paid to a resident, subject to statutory conditions and thresholds. The official provision also addresses consideration paid wholly or partly in kind, including an exchange for another VDA. The Income Tax Department’s TDS Rates page lists an annual threshold of ₹50,000 for a specified person and ₹10,000 for other payers.

Withholding does not establish the final tax computation or classify a service fee. Whether section 194S applies depends on the parties, payment flow, transaction and applicable statutory conditions—not simply on whether an AI tool or agent was used.
Check the tax year and Act version
The Income Tax Department’s 2026 VDA overview cites sections 115BBH and 194S of the Income-tax Act, 1961, while the Department also provides a VDA definition page under the Income-tax Act, 2025. Do not assume that section numbers or treatment carry across Act versions without checking the law applicable to the relevant tax year. Confirm the operative provisions and commencement rules for that year before filing or withholding.

Section 194-O concerns an e-commerce operator facilitating sales or services by an e-commerce participant, including digital products. A particular AI-agent marketplace, payer or payment arrangement may or may not meet the statutory facts. The existence of a platform, by itself, does not establish that section 194-O applies.

- Identify what was earned: a service fee, a token issuance or reward, or proceeds from disposing of an existing token.
- Record what was received: INR, foreign currency or a digital asset that may qualify as a VDA.
- Document the parties and arrangement: who provided the service, who paid, who received the token, and what contract or platform facilitated the transaction.
- Preserve timing and valuation evidence: when the amount was paid or credited and the records supporting the value attributed to it.
- Track what happened afterward: whether the token was sold, exchanged, gifted or otherwise transferred, with records of the event.
- Review withholding roles: whether section 194S conditions and thresholds are met, and whether the platform’s role could bring section 194-O into consideration.
These details matter because the official materials reviewed do not specifically resolve the treatment of token-denominated AI-agent service compensation, its valuation date and method, or how that receipt interacts with a later disposal. They also do not establish whether a particular marketplace is an e-commerce operator for section 194-O. An India-qualified chartered accountant or tax lawyer with VDA-tax experience can assess the contract, token and payment trail for the relevant year.
