If goods are detained under Section 129 of India’s Central Goods and Services Tax Act, keep three connected records: the documents required to accompany the movement, the commercial records that explain it, and every document created during inspection, detention, objection, payment or release. The exact file depends on what happened and whether you pay, dispute the proposed demand or seek release against security.
Start with the documents accompanying the goods
Rule 138A of the CGST Rules sets out the basic carried-document requirement for the person in charge of a conveyance: the applicable invoice, bill of supply or delivery challan, together with a copy of the e-way bill or its number, subject to the rule’s exceptions and applicable notifications. Check the current rule and any relevant notification for the particular movement. Read Rule 138A in the CGST Rules.
- Tax invoice: Keep it where applicable to the supply.
- Bill of supply: Keep it where that is the applicable document.
- Delivery challan: Keep it where the rules and circumstances call for one, including relevant movements that are not a sale.
- E-way bill: Keep the copy or number available as the rule permits, and retain the record needed to verify it.
Invoice and delivery-challan particulars are addressed in the CBIC invoice rules. The correct document depends on the transaction and movement; a delivery challan should not be treated as a universal substitute for an invoice. See the CGST Rules, including the invoice and delivery-challan rules.
Keep supporting records that explain the transaction and movement
The carried-document baseline is not the same as a complete business file. Preserve records that help establish what the goods are, who is sending and receiving them, their value and destination, and why they are moving. These are prudent supporting records; Section 129 does not enumerate each of them as a required carried document.

- Purchase or sales order and related transaction records.
- Dispatch, delivery and receipt records.
- Transporter details, vehicle information and relevant transport records.
- Correspondence or other records explaining the destination, delivery instructions or movement purpose.
- For a movement without a sale, the applicable delivery challan and records explaining the purpose of movement.
Use the documents that fit the actual transaction, and confirm the applicable treatment under the rules rather than assuming one set of paperwork applies to every movement. The CGST Rules address e-way bills, invoices and delivery challans.
Save records from inspection and detention
If an inspection occurs, keep the physical verification report served as FORM GST MOV-04 and related communications. CBIC Circular 41/15/2018-GST describes the inspection reporting procedure and corresponding EWB-03 entry. CBIC Circular 41/15/2018-GST.

If the officer detains the goods or conveyance, preserve the detention order in FORM GST MOV-06 and the notice in FORM GST MOV-07. Keep the documents themselves and proof of when and how they were served. The circular describes this sequence; a GST portal forms list identifies MOV-06 as the detention order and MOV-07 as the Section 129(3) notice. The portal list dates from 2019, so it identifies the forms but should not be read as confirmation that every current portal workflow is unchanged. Make a contemporaneous record of the interception, inspection, service and detention dates and times, the discrepancy stated by the officer, and the goods and conveyance details. This timeline can matter because Section 129(6) provides a seven-day period for payment before further proceedings under Section 130, with a possible shorter period for perishable or hazardous goods or goods likely to depreciate. Choose the right file for the next step
The records to preserve depend on whether you contest the proposed demand, seek release against security or pay. Not every case involves every MOV form.

Verify the current amount and applicable jurisdiction
Do not calculate a demand using an old Section 129 explainer. The provision has been amended, and its current statutory text should control. The applicable State or Union Territory GST enactment, local notifications, exceptions, transport mode and transaction facts may also affect the analysis. A document checklist alone cannot establish whether a particular detention is lawful or determine the amount applicable to an individual consignment; those questions depend on the actual records and jurisdiction-specific facts.
