The EU’s existing rules set a 100% emissions-reduction target for new cars and vans from 2035. The European Commission has proposed changing that to a 90% tailpipe-emissions reduction target, with compensation for the remaining 10%, but its policy page describes this change as a proposal. The existing standard therefore remains the rule unless and until the legislation is changed.
What the EU’s 2035 rule actually requires
Regulation (EU) 2019/631, revised by Regulation (EU) 2023/851, sets fleet-wide CO2 performance standards for newly registered passenger cars and vans. The European Commission lists a 2035 target of 0 g CO2/km for both categories—its 100% reduction target for new vehicles. The Council of the European Union summarized the adopted rule in a 28 March 2023 release as “100% CO2 emission reductions for both new cars and vans from 2035.”
This is often called a petrol and diesel “ban,” but the legal mechanism is an emissions standard for new registrations, not a prohibition on owning or driving a combustion-engine car already on the road. The rule does not require owners to scrap existing vehicles.
What the Commission has proposed instead
The Commission’s proposed revision would replace the 2035 100% target with a 90% reduction in tailpipe emissions. Under the proposal, the remaining 10% would be compensated through specified mechanisms involving low-carbon steel made in the EU, e-fuels or biofuels. The Commission says this design would allow plug-in hybrids, range extenders, mild hybrids and internal-combustion vehicles to continue to play a role after 2035, alongside electric and hydrogen vehicles.

That describes the proposal, not the current standard. A Commission proposal is not itself an enacted change to the regulation. The Commission also proposes “super credits” for small, affordable electric cars made in the EU before 2035, flexibility to bank and borrow compliance across 2030–2032, and reducing the 2030 van target from a 50% to a 40% reduction.

The Commission lists the following fleet-wide target levels under the existing framework:

These are fleet-wide performance targets, not a required emissions reading for every individual vehicle. A separate amendment adopted in June 2025 allows manufacturers’ compliance with the 2025–2027 targets to be assessed across those three years together instead of separately in each year. That changes the compliance period for those targets; it does not repeal the 2035 standard.
What this means if you plan to buy or keep a car
If you already own a petrol or diesel car
The 2035 standard is about new-vehicle registrations. It does not, by itself, outlaw ownership or use of a car already on the road.

If you expect to buy a new car in 2035 or later
Under the existing rule, the 2035 target is 0 g CO2/km for new cars and vans. If the Commission’s proposal is adopted, its compensation framework could allow some hybrid and combustion-engine models to remain in the new-vehicle market. The proposal alone does not guarantee which models will be available, or settle the final requirements.
Why the policy matters
The Commission says passenger cars account for around 16% of total EU CO2 emissions and vans around 3%. It reports that average emissions from new passenger cars fell 28% between 2019 and 2024, while average emissions from new vans fell 9% over the same period. In 2024, zero-emission vehicles represented 14.5% of new car registrations and 6.4% of new van registrations in the EU, Norway and Iceland.

How to read claims that the ban is “dead”
- Existing law: a 100% emissions-reduction target for new cars and vans from 2035.
- Commission proposal: a 90% tailpipe reduction target, with the remaining 10% compensated through specified mechanisms.
- Separate adopted flexibility: manufacturers may average compliance across 2025–2027 rather than meet the target separately in each year.
- Scope: the rule concerns new registrations, not a ban on keeping or driving existing combustion-engine cars.
For the proposal to change the current rule, it must proceed beyond proposal status and result in a legal amendment. The Commission’s policy page distinguishes the proposed revision from the standards already in force.
