A flag would not establish that someone committed fraud. The House passed the bill, but the latest official action located shows it was referred to a Senate committee on June 11, 2026; it had not become law as of that action.
What the bill would require
The reported House text focuses on federal student aid applications, not routine identity checks for every student. It would direct the Department of Education to use an identity-fraud detection system to review FAFSA applications submitted on or after October 1, 2026. The Department would also have to establish verification guidelines for institutions by that date. These are proposed requirements, not evidence that the system is already operating. What happens when an application is flagged
- If the system identifies reasonable suspicion of identity fraud, the Department would notify the applicant and the colleges named on the FAFSA.
- The institution would have to verify the applicant’s identity in person or through live, synchronous audiovisual verification. It could not disburse federal aid until it determined that reasonable suspicion was absent.
- The institution would notify the Department that identity was verified and retain a record of the verification.
In other words, the proposed trigger is suspicion requiring a check—not a finding of fraud. The bill text describes the required process, but the cited materials do not establish how the Department would define or apply “reasonable suspicion” in individual cases. House Report 119-669
Reporting requirements
The Secretary of Education would have to give Congress a written description of the system by November 1, 2026, and provide a description and rationale within 30 days of a substantial system change. Annual evaluation and reporting on the system’s use and effectiveness would begin no later than October 1, 2027. These provisions could give Congress information to assess the system, but they do not themselves specify a measured false-positive rate or an appeal process. House Report 119-669

Where the bill stands
The House passed H.R. 7892. The official GovInfo record says the Senate received it, read it twice, and referred it to the Committee on Health, Education, Labor, and Pensions on June 11, 2026. Why supporters back it and critics object
Supporters: reduce aid theft using stolen or fabricated identities
Supporters argue that screening could help stop people using stolen or fabricated identities from obtaining federal student aid. A June 10, 2026, House Republican Conference release claimed that more than $350 million in ghost-student fraud had been uncovered since 2019 and that attempted federal student-aid theft exceeded $1 billion in 2025. Critics: suspicion and verification could obstruct legitimate applicants
The American Federation of Teachers warned that broad discretion over suspicion standards could lead to uneven scrutiny, administrative burdens for colleges and students, and eligible people being discouraged from seeking aid. AFT President Randi Weingarten’s June 3 letter, reproduced in the Congressional Record, said: “Instead, they would harm marginalized households, create significant administrative barriers, and discourage eligible people from seeking assistance.” These are prospective concerns, not documented effects of an implemented system or a settled legal interpretation. What remains uncertain for genuine students
The materials available do not quantify how many genuine applicants might be flagged, how long verification would take, or how often the system might make a mistake. They also do not establish whether live verification would create accessibility, technology, scheduling, or staffing barriers in practice. The practical balance will depend in part on the Department’s suspicion criteria, the guidance it gives colleges, the routes available to correct a mistaken flag, and the evidence reported about effectiveness and false positives.

The Congressional Budget Office estimated implementation costs of less than $500,000 in 2026 and said any related spending would be subject to the availability of appropriated funds. That is an estimate of federal implementation costs; it is not a measure of colleges’ administrative burden or of the time or expense an applicant might face during verification.
