No: in a reported September 2026 decision, the GSTAT Agra Bench held that service tax paid under the pre-GST Finance Act, 1994 on advances for flat bookings later cancelled could not be claimed as GST input tax credit. The case report identifies a transitional refund process under section 142(5) of the CGST Act—not a unilateral credit-ledger adjustment—as the relevant route for tax on services not ultimately provided.
What did the GSTAT decide?
In Jupiter Buildtech Pvt. Ltd. v. Commissioner of State Tax – UP & Ors., the GSTAT Agra Bench reportedly dismissed the developer’s appeal. Taxscan identifies the matter as case APL/49/AGR/2026, decided on 24 September 2026, with Ajeet Singh as Judicial Member and Vivek Kumar as Technical Member. These case details and the outcome are reported by Taxscan; the signed order has not been independently reviewed here.
The reported reasoning draws a line between tax paid under the old service-tax law and input tax under GST. The tribunal was quoted as saying that service tax deposited under the Finance Act, 1994 “is not input tax and hence its credit is not allowed as input tax credit.” It reportedly rejected using GST returns as a way to obtain a refund of that earlier tax. The ruling therefore concerns the form of relief for this pre-GST payment, not ordinary GST credit on a developer’s current construction inputs.
What happened in the Jupiter Buildtech case?
According to Taxscan’s account, Jupiter Buildtech received advances totalling ₹1,28,80,050 for ten residential flats and paid ₹3,82,350 in service tax on those advances. Buyers cancelled the bookings in financial years 2018–19 and 2019–20. The developer refunded the advances and related service tax, then claimed the service tax as GST ITC and used that credit to adjust its GST liability.

The report says the proceedings involved ₹3,82,350 in tax, a ₹38,235 penalty and ₹3,39,401 in interest. These amounts, like the transaction details, are figures reported in the case summary rather than figures checked against the signed order.
Why did the tribunal reject the GST credit claim?
The reported distinction is that service tax paid under the Finance Act, 1994 is not GST “input tax.” A taxpayer cannot convert a refund of pre-GST service tax into GST ITC simply by entering it in the GST credit ledger. The tribunal reportedly also rejected the argument that this adjustment was revenue-neutral, and the contention that section 142(5) only allowed—but did not prescribe—a refund route. Taxscan’s report quotes the tribunal as stating that a taxpayer cannot adopt a mechanism unsupported by law.

That distinction matters because a credit-ledger entry offsets GST liability; it is not the same thing as obtaining repayment of tax paid under the former law. A claim for repayment must follow the legal mechanism applicable to that earlier tax, rather than being treated as a new GST input credit.
What does section 142(5) provide?
VILGST’s summary describes section 142(5) of the CGST Act as addressing refunds of tax paid under existing law where the relevant services were not ultimately provided. It says the claim is dealt with under the existing law and any amount accruing is paid in cash, rather than entered unilaterally as credit in the GST electronic credit ledger. What the decision does—and does not—settle
- It addresses a developer’s treatment of refunded pre-GST service tax. It does not concern the ordinary eligibility of GST ITC on current construction-related purchases.
- It distinguishes a refund from an ITC adjustment. The reported route is a transitional refund claim, not a self-directed credit entry in GST returns.
- It is not a universal ruling on cancelled bookings. It should not be read as deciding the GST treatment of every cancellation fee, retained amount, buyer refund or booking arrangement.
- It does not confirm entitlement in every case. Whether tax is refundable and whether a claim remains available require examination of the transaction and applicable procedural rules.
A separate Maharashtra advance-ruling matter involving Kolte Patil Developers considered cancelled pre-GST flat bookings, including situations with and without amounts retained. Its procedural history is distinct and does not determine Jupiter Buildtech’s appeal or establish a general answer for all booking cancellations.
