IRS Gift-Tax Relief for Trump Account Contributions: Who Qualifies in 2026

The IRS has created a narrow gift-tax reporting safe harbor for certain cash contributions to Trump Accounts. For 2026, an individual donor may avoid filing a gift-tax return to report qualifying contributions only if every condition in Revenue Procedure 2026-25 is met. This is reporting relief—not a tax deduction or a blanket exemption for everyone who contributes.

What the IRS announced

On June 29, 2026, the Treasury Department and IRS announced Revenue Procedure 2026-25. IRS Chief Executive Officer Frank J. Bisignano said the relief was intended to reduce concerns about gift-tax reporting for friends and family contributing to Trump Accounts. The procedure supplies a conditional safe harbor; it does not make every contribution automatically exempt from reporting.

Under the safe harbor, a qualifying contribution is treated as a completed gift, not a future interest in property, and the annual exclusion applies for gift tax, generation-skipping transfer (GST) tax, and gift-tax reporting. The procedure appears in the July 13, 2026 Internal Revenue Bulletin.

Do I have to file a gift-tax return for a Trump Account contribution?

Not necessarily. You can rely on this procedure’s no-filing result for a calendar year only if you are an individual donor and satisfy every condition below. The result applies to the qualifying contributions; it does not cancel a gift-tax return filing obligation you have for another reason.

  • Only qualifying gifts: Your only taxable gifts during that calendar year are cash contributions to one or more Trump Accounts.
  • Contribution timing: Each contribution is made before the beneficiary turns 18.
  • Annual limit per beneficiary: Your total gifts to each beneficiary, including the Trump Account contribution, do not exceed the annual gift-tax exclusion. Revenue Procedure 2026-25 uses $19,000 per beneficiary for 2026, as stated by the IRS and Treasury.
  • No remaining gift or GST tax: The gifts do not create gift-tax or GST-tax liability after applicable credits or exemptions.
  • No separate return requirement: Without counting the Trump Account contributions, you are neither required to file nor otherwise filing a gift-tax return for that year.

The $19,000 figure is the procedure’s 2026 threshold, not a permanent amount. For the limit, count your other gifts to the same beneficiary as well as the account deposit. The safe harbor is stated in Revenue Procedure 2026-25.

Who can contribute to a Trump Account?

The safe harbor addresses individual donors making qualifying cash contributions to a beneficiary’s account. It does not establish that every type of donor, transfer, or contribution qualifies. A contribution made after the year the beneficiary turns 18, or one that fails another condition, is outside this particular safe harbor.

Even if your Trump Account contribution fits the procedure, another taxable gift or a separate filing obligation can change the result. Consider your gifts to each beneficiary and your overall filing circumstances for the year rather than assessing the account deposit in isolation.

Does the IRS safe harbor mean Trump Account contributions are tax-free?

No. The announcement concerns gift-tax treatment and reporting under specific conditions. It does not announce a tax deduction for the donor or a universal tax exemption for every contribution. Nor does the safe harbor itself establish the tax treatment of investment earnings or withdrawals.

How do I open a Trump Account for my child?

IRS guidance says an authorized person can elect to open an initial account using Form 4547 or the online Form 4547. Check the IRS’s Trump Account opening guidance for current instructions. Treasury directs families to TrumpAccounts.gov for program eligibility, safeguards, and features, and to the official app to view and manage accounts.

Which children qualify for the $1,000 Trump Account contribution?

The IRS announcement says a U.S. citizen born in 2025 through 2028 may be elected for the one-time $1,000 pilot contribution. Check current IRS and Treasury guidance for eligibility and election details before acting; the pilot contribution is separate from the gift-tax safe harbor for individual donors.
