Magnum, the ice-cream company spun out of Unilever’s ice-cream business, disputed his perspective and said it remained committed to the brand’s mission. The dispute is about the founders’ agreement and company governance; the cited reporting does not establish that a court has resolved the competing claims.
Why did Jerry Greenfield leave Ben & Jerry’s?
In a letter published September 17, 2025, Greenfield said Ben & Jerry’s had spent more than 20 years speaking about peace, justice, and human rights, and that he and co-founder Ben Cohen negotiated an agreement intended to protect the company’s social mission after its sale to Unilever. Greenfield said he could no longer remain with the company in good conscience because, in his view, that independence had been lost.
“It’s profoundly disappointing to come to the conclusion that that independence, the very basis of our sale to Unilever, is gone.”
Greenfield also wrote: “Standing up for the values of justice, equity, and our shared humanity has never been more important, and yet Ben & Jerry’s has been silenced, sidelined for fear of upsetting those in power.” These are Greenfield’s descriptions of the situation, not findings about what the agreement legally requires.

What did Magnum say about his resignation?
A Magnum spokesperson said the company disagreed with Greenfield’s perspective and had tried to speak constructively with both co-founders. The spokesperson said: “We disagree with his perspective and have sought to engage both co-founders in a constructive conversation on how to strengthen Ben & Jerry’s powerful values-based position in the world.” Magnum also said it remained committed to the brand’s mission. Its response does not by itself settle the contractual dispute.
What does Ben & Jerry’s mission say?
Ben & Jerry’s official values page describes three parts of its mission that should thrive equally:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- Product: making ice cream.
- Economic: pursuing sustainable financial growth.
- Social: using the company in ways that improve quality of life locally, nationally, and internationally.
That framework helps explain why Greenfield presents his departure as a dispute over the company’s identity and governance, rather than a disagreement about a product decision. It does not establish whether the merger agreement has been breached.
How the dispute developed
| Date | What happened |
|---|---|
| 2000 | Unilever acquired Ben & Jerry’s for $326 million, according to The Associated Press. AP reported that the partnership was presented as a way to expand the company’s social mission. |
| 2021–2022 | Ben & Jerry’s announced it would stop serving Israeli settlements in the occupied West Bank and contested east Jerusalem. In 2022, Unilever sold its Israeli business to a local operator, which said it would sell Ben & Jerry’s under its Hebrew and Arabic name in Israel and the West Bank. |
| March 2025 | Ben & Jerry’s said Unilever unlawfully removed CEO David Stever in retaliation for the company’s activism. AP described the company’s account of a disagreement over the merger agreement’s CEO-removal process; this is an allegation, not a court finding. |
| September 2025 | Greenfield resigned, citing the loss of independence to speak on social issues. Magnum disputed his perspective and said it remained committed to the brand’s mission. |
| December 7, 2025 | The Ben & Jerry’s Foundation board alleged that Unilever/Magnum initiated an unusual audit, withheld Foundation funding, and sought to remove independent-board chair Anuradha Mittal as a Foundation trustee. The board said it had not seen the final audit report. These are the board’s claims, not an independent audit conclusion or court ruling. |
| April 7, 2026 | The Free Ben & Jerry’s campaign said Ben Cohen brought petitions to Magnum’s Amsterdam headquarters and that campaign staff said employees did not accept the petition box. This account comes from the campaign. |
Did Unilever silence Ben & Jerry’s activism?
That is Greenfield’s characterization, not an established legal conclusion. The dispute centers on how much independence the founders’ agreement guarantees and who controls the company’s public statements. Ben & Jerry’s has also sued Unilever over statements concerning Palestinians and Gaza, and over a proposed social-media post about minimum wages, universal health care, abortion, and climate change. The Associated Press described these as claims in litigation; the sources cited here do not establish a final resolution.

The distinction matters: Greenfield’s account, Magnum’s response, the company’s allegations, and the Foundation board’s allegations describe competing positions. None should be treated as a judicial finding about the agreement or the parties’ conduct.

The campaign associated with founders Ben Cohen and Jerry Greenfield calls for Ben & Jerry’s to have independent ownership. Its site also describes campaign activity, including the petition delivery account above. A petition total should be treated cautiously: the campaign page reports over 100,000 signatures but displays a different count in its footer, so the page is internally inconsistent and does not provide an independently audited number.
