It has opened a route for individual exporters to replace countervailing duties with an accepted minimum-price undertaking. The first identified deal covers Volkswagen (Anhui)’s CUPRA Tavascan, and its duty exemption applies only when the undertaking’s conditions are met.
What changed in the EU–China EV pricing talks?
The change is a conditional alternative to the EU’s duties, not a general tariff repeal or blanket agreement with China. On January 12, 2026, the European Commission issued guidance for exporters proposing price undertakings. On February 9–10, it adopted and announced acceptance of Volkswagen (Anhui)’s offer for the CUPRA Tavascan, with SEAT S.A. as the related EU importer. The offer is the first accepted undertaking identified in the cited official status update.
The Commission said each offer would be assessed against the same legal criteria, objectively and without discrimination, in accordance with WTO rules. The guidance establishes how offers may be submitted; it is not evidence that duties have been lifted generally. Read the Commission’s guidance announcement.
Are Chinese electric cars still subject to EU tariffs?
Yes. The definitive countervailing duties imposed in October 2024 remain in force for covered new battery electric vehicles originating in China, except where imports qualify for an accepted price undertaking or another applicable legal treatment. The consolidated regulation specifies company-specific rates from 7.8% to 35.3%; the rate depends on the company and the regulation’s provisions, rather than being one uniform tariff for every vehicle.

The measure covers a defined category of new battery electric vehicles principally designed to carry nine or fewer people, including the driver. Product and origin definitions in the regulation govern whether a particular vehicle is covered. See the consolidated Commission Implementing Regulation (EU) 2024/2754. How does a minimum-price undertaking work?
An exporter voluntarily commits to import covered vehicles at or above a minimum import price accepted by the Commission. In return, qualifying imports covered by the undertaking can be exempt from the countervailing duties that would otherwise apply. This is not simply a manufacturer choosing a retail price: the Commission assesses the proposal, specifies the product and terms, and monitors compliance.

The Commission has said an offer must meet legal requirements, including fully offsetting the effects of Chinese subsidisation compared with the duties and being practicable enough to mitigate the risk of cross-compensation. The accepted Tavascan decision sets out implementation terms including a minimum price, annual quota, designated sales channels, declarations and invoices, sales reporting, and verification obligations. The Commission also said the undertaking includes EU investment milestones.

These are import-treatment routes for exporters and importers under trade rules, not options a consumer selects at checkout. The terms of one accepted undertaking should not be assumed to apply to other manufacturers or models.
Can the CUPRA Tavascan avoid the EU tariff?
Qualifying Tavascan imports covered by Volkswagen (Anhui)’s accepted undertaking can be exempt from the countervailing duty if they meet its conditions, including the minimum import price and the specified quota, sales-channel, documentation, reporting, and verification requirements. It is not an unconditional exemption for every Tavascan or every shipment.

How many price undertakings has the EU accepted?
In an answer last updated April 13, 2026, the Commission told the European Parliament that it had accepted one undertaking to date. That is a dated status snapshot, not a verified count for October 2026. The answer also describes vehicle-level monitoring and on-site inspections, and says duties may be reinstated, including retroactively, if an undertaking is not observed. The available official terms establish a minimum import price and conditions for duty exemption; they do not establish whether consumer prices or sales changed after the Tavascan undertaking. A duty exemption does not, by itself, prove that a vehicle’s retail price will fall: the undertaking requires imports to meet a price floor, and the cited sources do not report resulting consumer prices or sales effects.
