How was this different from Flagstar’s January 2021 breach?
Flagstar had a separate incident in January 2021 involving a file-sharing platform. Settlement materials describe that incident as affecting about 1.47 million people and say approximately 2,187,170 U.S. consumers were affected by the two 2021 incidents combined. Those are different counts: the 1,547,169 figure refers to the December incident, while the larger combined number is the settlement class scope reported by the administrator. What did the SEC say about Flagstar’s disclosures?
On December 16, 2024, the U.S. Securities and Exchange Commission announced settled charges tied to Flagstar’s statements about the late-2021 breach. The SEC’s order found that Flagstar negligently made materially misleading statements: the company described unauthorized access while knowing of network disruption, data encryption and the exfiltration of personally identifiable information. The SEC said approximately 1.5 million individuals had PII exfiltrated. Flagstar agreed to pay a $3.55 million civil penalty without admitting or denying the findings. The SEC settlement is a regulatory action about corporate disclosures. It is separate from the consumer class settlement, and it should not be treated as a court finding that Flagstar was liable to consumers in that private case.

What was included in the consumer class settlement?
The administrator described a $31.5 million settlement fund for a class of approximately 2,187,170 U.S. consumers identified by Flagstar as affected by either or both 2021 incidents. The settlement notice said Flagstar denied the plaintiffs’ claims and that, when the notice was written, no court had determined Flagstar was liable or had done anything wrong in the case. The administrator listed these potential benefits:
- Documented losses: Reimbursement of up to $25,000 for eligible documented monetary losses.
- Residual cash payment: An estimated $60 pro rata payment, subject to adjustment based on claims and capped at $599.
- Credit monitoring: Three years of three-bureau monitoring with identity restoration features for eligible claimants.
- California residents: An additional statutory-payment option was described for eligible California class members.

Has the settlement been finally approved, and when will payments arrive?
The court entered preliminary approval on March 12, 2026, and the settlement site listed a final approval hearing for October 1, 2026, at 9:30 a.m. ET. That hearing date has passed. What should you do if your information may have been exposed?
- Verify the notice. Contact Flagstar using contact information found independently on its official website and ask which incident and records the notice concerns.
- Review accounts and credit reports. Look for unfamiliar transactions or accounts, and consider placing a fraud alert or credit freeze with the credit bureaus if you are concerned about misuse of your Social Security number.
- Be alert for identity fraud. Treat unexpected requests for money, login details or verification codes cautiously, particularly if they refer to the breach.
- Check settlement updates. Because the claim deadline has passed, do not assume a new claim can be filed or that a payment is coming. Consult the administrator’s current notices for court status and any next steps.
