Johnson & Johnson announced a proposed $5.5 billion resolution of remaining ovarian talc claims on July 27, 2026. The proposal is conditional, including on plaintiff firms representing at least 95% of the remaining claims agreeing to participate; the available information does not establish that this threshold has been met or that the proposal is final. J&J says the first payment would be no more than $3 billion in 2027, with no additional payment due before 2028.
What J&J is proposing
The July 2026 proposal addresses remaining ovarian talc litigation, not every cancer lawsuit involving talc. J&J describes it as covering claims led by firms involved in the federal multidistrict litigation (MDL) and related state proceedings. The company says the arrangement depends, among other criteria, on participation by plaintiff firms representing at least 95% of remaining claims. Its announcement does not establish that the condition has been satisfied or that a court has approved an effective settlement.

Its announcement describes the remaining ovarian caseload as roughly 76,000 claims; these are the company’s separate descriptions, not a more precise verified count. The filing is available through the SEC.
Why the headline says $6.5 billion
The $6.5 billion figure refers to an earlier proposal, not the current one. In 2024, J&J proposed a bankruptcy plan with an estimated present value of about $6.475 billion to be paid over 25 years. Its July 2026 announcement instead describes a proposed $5.5 billion commitment for remaining ovarian claims. The two proposals differ in amount, procedural route, claim scope and payment terms.

What happened to the bankruptcy strategy
J&J tried to resolve talc claims through subsidiary Chapter 11 proceedings. In March 2025, the U.S. Bankruptcy Court for the Southern District of Texas denied Red River Talc LLC’s request to confirm its proposed plan. J&J said it would return to the tort system in its March 31, 2025 announcement. The company’s descriptions of the claims and proceedings are its own characterizations, not findings by the court.

J&J’s second-quarter 2026 SEC filing says all three talc-related Chapter 11 proceedings were dismissed and litigation resumed in the tort system. It also says the company reversed about $7.0 billion previously reserved for the bankruptcy resolution in the first quarter of 2025. The filing reported a present-value reserve of about $3.7 billion for talc-related matters as of the second quarter of 2026. That reserve includes executed settlements, defense costs and other costs; it is not the amount of the newly announced proposal.
Which claims are—and are not—covered
The proposal concerns remaining ovarian talc claims. J&J separately says it has settled about 95% of filed mesothelioma lawsuits, all state consumer-protection claims and all talc-supplier disputes. Those are distinct categories, not additional parts of the ovarian proposal.

J&J also said in its July 2026 announcement that the federal MDL court had ordered plaintiffs to show why remaining claims should not be dismissed for inability to prove specific causation, after plaintiffs withdrew two specific-causation experts in bellwether cases. That is the company’s description of the procedural development; the cited source is its announcement, not the underlying court order. Erik Haas, J&J’s worldwide vice president of litigation, characterized the order by saying plaintiffs were in an “untenable position” because, in his view, the specific-causation evidence needed to maintain their claims did not exist. This is an executive’s statement, not a neutral court finding.

An announced commitment is not the same as an effective settlement or a payment. The 95% participation threshold is a stated condition, and J&J’s announcement does not show whether that condition or the proposal’s other criteria have been met. The sources cited here therefore do not establish that the proposal is final, court-approved or paid.
