What Seniors Need to Know About Congress’ Big Budget Bill

The 2025 budget law created a temporary tax deduction for many people 65 and older, but it did not make Social Security universally tax-free. Its SNAP and Medicaid provisions have distinct age and eligibility rules.

Public Law 119-21, signed on July 4, 2025, gives eligible taxpayers age 65 and older a temporary federal income-tax deduction of up to $6,000 per person for 2025 through 2028. It does not make Social Security benefits universally tax-free, and its SNAP and Medicaid changes have different age rules and effects. Here is what older Americans should know about each provision—and where to check the rules that apply to them.

What the bill changes for older taxpayers

The enhanced deduction for seniors

For tax years 2025 through 2028, an eligible taxpayer who is 65 or older can claim an additional federal income-tax deduction of up to $6,000. A married couple filing jointly may claim up to $12,000 if both spouses qualify. The amount phases down when modified adjusted gross income exceeds $75,000 for a single filer or $150,000 for a joint filer.

This is a deduction from taxable income, not a tax credit. It does not reduce a tax bill dollar for dollar or guarantee a refund. The deduction is available whether a taxpayer itemizes deductions or claims the standard deduction, and it is in addition to the existing additional standard deduction for older taxpayers. Taxpayers with higher income may receive a reduced deduction or no enhanced deduction.

Who can claim it on a 2025 return

For 2025 returns, IRS guidance says the taxpayer—and a qualifying spouse on a joint return—must have been born before January 2, 1961, and must meet the applicable valid Social Security number and filing requirements. Because the deduction is temporary, it applies to tax years 2025, 2026, 2027 and 2028; it is not a permanent change to the tax code.

To claim it, check the current IRS Schedule 1-A and Form 1040 instructions for the return year. People who qualify may also seek free preparation through IRS Volunteer Income Tax Assistance (VITA), Tax Counseling for the Elderly (TCE), or AARP Foundation Tax-Aide. Paying for tax software or professional help is not a condition of eligibility.

Does the bill make Social Security tax-free?

No. The bill does not repeal the general federal income-tax rules for Social Security benefits. Instead, eligible older taxpayers may use the new deduction to reduce taxable income, which can lower the amount of federal income tax they owe. Whether any of a person’s benefits are taxable still depends on their circumstances and the existing tax rules.

A July 2025 Social Security Administration (SSA) release said nearly 90% of beneficiaries would no longer pay federal income taxes on their benefits. That was the agency’s characterization of the deduction’s expected effect, not a promise that every beneficiary’s benefits are exempt. The release was corrected on July 7, 2025; the IRS describes an age- and income-limited deduction, not a blanket Social Security tax exemption.

The deduction does not change an individual’s Social Security benefit formula or monthly payment. The SSA’s 2026 Trustees Report says the deduction reduces taxable income for many beneficiaries and, as a result, reduces income-tax revenue flowing to the Old-Age and Survivors Insurance and Disability Insurance trust funds.

Is the 2026 Social Security increase part of the bill?

No. Social Security and Supplemental Security Income (SSI) recipients receive a 2.8% cost-of-living adjustment (COLA) in 2026. SSA published that adjustment in 2025 based on the change in the Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W) from the third quarter of 2024 through the third quarter of 2025. It is the ordinary annual COLA, separate from Public Law 119-21.

What the SNAP work-rule change means for older adults

The bill expands the age range covered by the able-bodied-adult-without-dependents work requirement to include adults ages 55 through 64. People age 65 and older are outside that specific expansion. This does not mean that everyone 65 or older qualifies for SNAP: household income, other program rules and individual circumstances still matter.

The law also changes SNAP financing and administration and includes benefit-calculation provisions. The effect on a particular household depends on the provision, the household’s situation, applicable exceptions and state administration. The Congressional Research Service (CRS), summarizing Congressional Budget Office (CBO) estimates, reports that the nutrition subtitle is projected to reduce federal spending by almost $187 billion over fiscal years 2025–2034. That is a federal spending estimate, not a calculation of how much any one household’s benefits will change.

Does the Medicaid requirement apply to Medicare recipients?

The new Medicaid community-engagement requirement applies to certain people in Medicaid expansion coverage who are under 65. It is not a new general work requirement for people receiving Medicare. Medicaid and Medicare are separate programs, and the requirement described here concerns specified Medicaid expansion adults—not older Medicare beneficiaries as a group.

The law’s health provisions go beyond that requirement and include other Medicaid eligibility, financing and provider-payment changes. CRS reports that CBO estimates these health provisions will reduce federal outlays by $1.1 trillion over fiscal years 2025–2034 and leave 10.0 million more people uninsured in fiscal year 2034 than under CBO’s January 2025 baseline. These are nationwide projections, not estimates of what a particular older person will lose or whether that person will qualify for coverage.

Implementation involves federal guidance, technical assistance, compliance timelines and rulemaking. For a personal eligibility or timing question, check current CMS guidance and contact your state Medicaid agency; a general federal summary cannot determine how a provision applies to an individual case.

What to check before acting

  • For the tax deduction: Use the IRS instructions for the tax year you are filing, including Schedule 1-A and Form 1040, and check the age, filing, Social Security number and income rules.
  • For SNAP: Ask your state SNAP agency how the enacted changes and applicable exceptions affect your household. Age alone does not determine eligibility.
  • For Medicaid: Ask your state Medicaid agency about your coverage category and applicable implementation rules, and consult current CMS guidance.
