What the SEC Chair does
The Securities and Exchange Commission describes its Chair as the agency’s top executive, responsible for the Commission’s executive and administrative functions. That means the Chair leads the SEC’s work as an institution; the role is not the same as personally deciding every matter before it.
The SEC’s mission is to protect investors, maintain fair, orderly, and efficient markets, and facilitate capital formation. The Chair’s leadership takes place within that mission and the five-member Commission. In a 2007 speech, then-Chair Christopher Cox described the job as carrying out the SEC’s “day-to-day executive functions.” He also explained that, generally, the five commissioners vote on official SEC decisions.
How the Chair is appointed
There are two distinct steps: appointing someone to the Commission and designating a commissioner to lead it. The Senate’s advice and consent applies to the commissioner appointment; the SEC’s explanation describes the Chair as selected from among the commissioners by presidential designation.

The Chair designation does not create another Commission seat. The SEC’s explainer says the President “also designates one of the Commissioners as Chairman,” identifying the Chair as the SEC’s top executive.
How the Chair fits into the Commission
The SEC describes a five-commissioner Commission with staggered five-year commissioner terms. No more than three commissioners may belong to the same political party. These are rules about the Commission’s membership and commissioner service, not a separate fixed Chair term. The SEC also notes that a commissioner may continue serving for approximately 18 months beyond the end of a term if no replacement has been appointed.

Because the Chair is one member of this Commission, executive leadership and formal Commission decisions should be kept distinct: the Chair leads the agency’s executive and administrative functions, while official Commission decisions are generally made by commissioners voting.

Trump nominated Atkins on January 20, 2025; the Senate confirmed him on April 9, 2025; and he was sworn in as the 34th Chair on April 21, 2025. The officeholder can change, so this dated identification should not be treated as permanent.
