France is the clearly verified national case: its law sets a 2040 objective to end sales of new passenger cars and light commercial vehicles that use fossil fuels. That is not a ban on driving cars already on the road. The European Union has a separate 2035 rule for new cars and vans, while the COP26 declaration is an international commitment to work toward zero-emission sales—not a domestic ban.
Which nations have a 2040 objective?
France’s current Mobility Orientation Law, Article 73, sets the clearest verified national 2040 objective. It calls for “La fin de la vente des voitures particulières et des véhicules utilitaires légers neufs utilisant des énergies fossiles, d’ici à 2040” (“The end of sales of new passenger cars and light commercial vehicles using fossil fuels by 2040”). The law also sets a distinct 2040 objective for new heavy vehicles used to transport passengers or goods that use fossil fuels predominantly. The provision is part of a wider objective of complete decarbonization of land transport by 2050.
“Gas-powered” is shorthand here: the French provision covers fossil fuels, not gasoline alone. The official materials establish France’s objective in detail, but do not establish a comparable current list of other national 2040 measures. It would be misleading to treat older target lists or international pledges as proof that multiple countries have enacted the same kind of law.

What does France’s 2040 objective cover?
The measure concerns sales of covered new vehicles. Article 73 does not itself require owners to scrap gasoline or diesel cars, prohibit used-car sales, or ban driving existing vehicles in 2040. Restrictions on driving in particular places, or rules for secondhand vehicles, would be separate policies.
The provision describes an objective, not a blanket prohibition on every vehicle with a combustion engine. Its stated scope is new passenger cars and light commercial vehicles using fossil fuels, with a separate provision for predominantly fossil-fuel-using new heavy vehicles. The cited text does not specify exemptions or enforcement details, so those should not be inferred from the 2040 date alone.

How the EU’s 2035 rule differs
The EU framework has an earlier date, but a different legal mechanism. Regulation 2023/851 revises the CO₂ performance standards for new passenger cars and vans. The European Commission summarizes the change as a 100% emissions-reduction target from 2035. It is an EU-wide fleet-emissions rule, not France’s national 2040 sales objective and not a rule requiring existing cars to leave the road. The distinction matters because “zero emission” is a policy summary, while the regulation works through fleet-average CO₂ performance standards for new vehicles. The two descriptions are related, but they are not interchangeable with a general ban on driving petrol or diesel cars.

For context, the Commission reported that zero-emission vehicles accounted for 14.5% of new car registrations and 6.4% of new van registrations in the EU, Norway, and Iceland in 2024. No. The COP26 declaration says its signatories “will work towards all sales of new cars and vans being zero emission by 2040 or earlier, or by no later than 2035 in leading markets.” That is a commitment to work toward an outcome, not by itself a domestic law prohibiting sales. Whether a country has an enforceable measure depends on its own legislation or regulations. COP26 declaration on zero-emission cars and vans.

How to read claims about a 2040 “ban”
- Check the jurisdiction: France’s 2040 objective is national; the EU’s rule applies across the EU under a separate framework.
- Check the legal status: distinguish an enacted law or regulation from a government objective or an international declaration.
- Check what is covered: new-vehicle sales, fleet CO₂ performance, and driving vehicles already owned are different matters.
- Check the vehicle and fuel terms: France’s law refers to fossil-fuel use and names vehicle categories; it is not limited to gasoline passenger cars.
