The GST Council usually seeks consensus, but if it votes, a proposal needs at least three-fourths of the weighted votes of members present and voting. The Union Government has one-third of the votes cast and State Governments together have two-thirds; a meeting requires at least half of the Council’s total membership for quorum.

Who sits on the GST Council?

Article 279A of the Constitution establishes the Council as a joint Union–State forum. It comprises the Union Finance Minister, who chairs it; the Union Minister of State in charge of Revenue or Finance; and one minister nominated by each State Government, responsible for finance or taxation, or otherwise nominated by that government. The State members choose a Vice-Chairperson from among themselves. Article 279A: GST Council membership

The Council recommends policy on matters such as which taxes are subsumed into GST, taxable and exempt supplies, model GST laws, levy and place-of-supply principles, turnover thresholds, rates, disaster-related special rates, and special provisions for specified States. The Constitution directs it to be guided by a harmonised GST structure and the development of a harmonised national market. Article 279A: Council functions

How does a decision pass?

Consensus is the usual approach

The Council generally works by consensus. Consensus is its usual practice, not a separate voting threshold in the Constitution. If a proposal is put to a vote, the formal constitutional rule applies.

A vote requires three-fourths of weighted votes

Under Article 279A(9), a decision taken at a meeting must receive at least three-fourths of the weighted votes of members present and voting. The Union’s vote accounts for one-third of the total votes cast, while the State Governments together account for two-thirds. Article 279A(9): voting rule GST Council consensus practice

The weights do not mean that every State has an equal fixed share of the entire Council vote regardless of attendance. The Council’s procedural illustration apportions the States’ collective two-thirds among States present and voting. Can a decision pass without the Union’s support?

The published arithmetic shows that the Union does not have an automatic veto: sufficiently strong State support can reach the three-fourths threshold even without Union support. That is a consequence of the weighted formula, not a claim about how often the Council decides against the Union. Conversely, Union support alone is only one-third and cannot meet the threshold. The outcome depends on the weighted votes of members present and voting, not simply on counting governments.

What is the quorum?

One-half of the Council’s total membership constitutes quorum. Article 279A(7) states: “One-half of the total number of Members of the Goods and Services Tax Council shall constitute the quorum at its meetings.” Article 279A(7): quorum

The Council’s rules require a duly constituted meeting chaired by the Chairperson, with at least half of the members present. A member cannot send an authorised substitute. How are States represented?

Each State Government nominates one minister to the Council. That minister is the State’s Council member; State officials do not replace the member for attendance or voting purposes. The State members collectively hold two-thirds of votes cast when a vote is taken, with the State portion apportioned among those present and voting under the Council’s procedure. How often does the Council meet, and how much notice is required?

The procedural rules say the Council should meet at least once in every quarter of the financial year. Ordinary meetings require at least seven days’ notice. With the Chairperson’s approval, an emergency meeting may be called on two days’ notice. GST Council meeting and notice rules

What these rules do—and do not—settle

The voting provisions describe how the Council reaches a decision within a meeting. Whether its recommendations bind Union or State legislatures is a separate legal question; the voting and quorum rules alone do not answer it.
