What the Stalled CLARITY Act Means for Crypto Investors and Businesses

The CLARITY Act remains unpassed after a failed Senate cloture vote. Here is what the stall means—and how to distinguish the bill from agency interpretation and SEC proposals.

As of October 4, 2026, the CLARITY Act has not become law. The Senate failed to advance it in a September 15 cloture vote, so investors and crypto businesses still lack the durable federal market-structure framework the bill was designed to create. Separate SEC and CFTC actions may shape how existing law is interpreted, but they are not passage of the Act.

What happened to the CLARITY Act?

H.R. 3633, the Digital Asset Market Clarity Act of the 119th Congress, is a proposed federal framework for regulating digital-commodity offers and sales through the SEC and CFTC, among other provisions. It remains a bill, not a law. The GovInfo bill record lists a Senate-reported version and a last-action date of June 1, 2026; later committee and sponsor announcements describe additional work on the measure.

Its Senate path

The Senate Banking Committee announced text as the basis for a markup on May 12. Senator Cynthia Lummis later said the bill passed that committee 15–9 in May. On July 22, she announced updated text reflecting merged work products from the Banking and Agriculture committees. Those were procedural milestones tied to particular versions, not enactment.

On September 15, the Senate voted 49–50 on cloture; 60 votes were required to advance the measure. The Associated Press reported that ethics safeguards concerning President Trump’s crypto interests were a central Democratic objection. That is reported political context, not proof it was the sole reason senators opposed the bill.

After the vote, House Financial Services Committee Chairman French Hill and House Agriculture Committee Chairman Glenn “GT” Thompson said the vote did not remove the need for legislation. They also said they expected federal regulators to use existing authorities to develop rules and guidance while Congress pursued statutory certainty. Their statement reflects the chairs’ position, not a neutral finding that agency action can provide the same durability as a statute.

What does the stall mean for crypto investors?

No new statutory certainty from this bill

The Act has not established its proposed market-structure framework. Its stalled progress does not, by itself, determine whether any particular token is a security or a commodity. Classification and legal treatment depend on the asset, transaction, and relevant facts; a headline about the bill cannot resolve an individual investor’s position.

Agency guidance is a separate development

On March 17, 2026, the SEC announced an interpretation joined by the CFTC. It addresses categories including digital commodities, collectibles, tools, stablecoins, and securities; when a non-security crypto asset may become or cease to be subject to an investment contract; and the treatment of airdrops, protocol mining, staking, and wrapping. The SEC said the interpretation complements Congress’s effort to codify a market-structure framework. It is an agency interpretation, not the CLARITY Act.

A vote does not provide a price signal

The reported vote does not establish that crypto prices should rise or fall, or that a particular token will be affected in a predictable way. The cited reporting and official statements provide no reliable estimate of price effects, passage odds, or investment outcomes. Treat the legislative status as policy context, not as a stand-alone buy or sell signal.

What does the stall mean for crypto businesses?

Issuers, trading platforms, intermediaries, and other market participants should distinguish the rules and guidance currently in force from proposals that may change. Questions involving asset classification, transaction structure, and SEC or CFTC jurisdiction remain relevant, but the stalled bill has not automatically eliminated registration duties, settled every jurisdictional boundary, or authorized any particular business model.

  • Statute: legislation enacted by Congress and signed into law or otherwise made law through the applicable process. The CLARITY Act is not at this stage.
  • Agency interpretation: the SEC-CFTC interpretation announced in March describes how the agencies view existing legal categories and activities; it is distinct from legislation.
  • Proposed rule: an agency proposal is not a final rule or an operative entitlement. Check whether a proposal has subsequently been finalized before relying on it.
  • Final rule or guidance: determine its current status, scope, and applicability rather than assuming every agency statement has the same legal effect.

The House committee chairs said agencies may use existing authorities for rules and guidance during the legislative impasse. SEC Chair Paul Atkins, in an August 18 statement, argued that legislation remains indispensable for durable rules. These positions underscore the difference between interim agency action and a statutory framework.

What the SEC’s August proposals do—and do not—mean

In his August 18, 2026 statement, SEC Chair Paul Atkins described proposed SEC rules that included a startup exemption for offerings up to $5 million during a four-year period, a fundraising exemption for up to $75 million each year, and an investment-contract safe harbor subject to conditions. These are proposal thresholds described by the Chair, not exemptions already granted by the CLARITY Act or a guarantee that a particular offering qualifies. Businesses would need to check the proposals’ status and full conditions before relying on them.

Atkins said legislation remained indispensable to “future-proofed” rules durable enough to protect current work from being unwound by a future regulator. That is his stated view about why legislation matters; it does not change the legal status of either the bill or the proposed agency rules.

What to watch next

  • Bill status: look for a new Senate action or updated official bill record; a failed cloture vote is not enough to call the bill permanently dead.
  • Version and procedure: identify whether an announcement concerns a committee draft, Senate-reported text, floor action, or enacted law.
  • Agency status: distinguish an interpretation or guidance from a proposed rule and from a final rule, and verify the rule’s effective status.
  • Specific legal questions: assess the asset, transaction, platform role, and applicable authority rather than inferring an answer from the bill’s broad title.

The September 15 vote establishes that the Act failed to advance at that point. It does not establish what Congress will do next, how regulators will act, or what effect the stall will have on any particular investor or business.
