Trump Administration Paused the $5 Billion EV Charger Program That Awarded Funds to Tesla—What Happened Next

The 2025 NEVI funding pause was ruled unlawful, but later legislation repurposed part of the money. Washington’s proposed Tesla awards total $1,275,911—not a nationwide figure.

The Trump administration’s 2025 actions halted key steps in the $5 billion National Electric Vehicle Infrastructure (NEVI) program, which funds public EV charging through states and has awarded money to Tesla. In January 2026, a federal court ruled the suspension actions unlawful. But that did not restore every dollar: a later FY2026 law repurposed more than $503 million in previously distributed NEVI funds. Washington’s proposed Tesla awards total $1,275,911 for two sites; that is a state-level figure, not a nationwide total.

What the $5 billion EV charging program funds

Congress created NEVI in the Infrastructure Investment and Jobs Act, signed on November 15, 2021. It appropriated $5 billion over five fiscal years, FY2022 through FY2026, for states to develop a national network of EV charging infrastructure. The Federal Highway Administration (FHWA) administers the formula funding through state transportation agencies. NEVI is a public-charging infrastructure program, not a grant program reserved for Tesla.

FHWA’s FY2026 apportionment notice identified $1 billion appropriated for that fiscal year before the notice’s administrative retention and set-asides. That annual statutory amount is distinct from the later decision to repurpose a portion of previously distributed NEVI balances.

What happened to the NEVI funding freeze?

The sequence matters: the administration directed a pause, FHWA suspended plan approvals and new obligations, a court later ruled those suspension actions unlawful, and Congress subsequently repurposed part of the funding. Those are separate actions; it is not accurate to say either that all $5 billion was canceled or that all of it was restored.

Date Action What it meant
January 20, 2025 President Trump signed Executive Order 14154, “Unleashing American Energy.” The order directed agencies to pause disbursements of certain Infrastructure Investment and Jobs Act and Inflation Reduction Act funds, including NEVI funds.
February 6, 2025 FHWA rescinded earlier NEVI guidance and issued a memorandum suspending state EV infrastructure deployment plans pending revised guidance and new state plans. The agency action affected plan approvals and new obligations, as well as the program’s funding flow.
June 2025 A court issued a preliminary injunction in litigation brought by states. This interim ruling ordered restoration for a group of plaintiff states; it was not the later final judgment.
August 2025 FHWA issued revised Interim Final Guidance, effective immediately while the agency sought comments. The revised guidance replaced the earlier approach. It remained in effect in the January 2026 court record.
January 23, 2026 The U.S. District Court for the Western District of Washington granted summary judgment to the states. The court held that the February 2025 suspension actions exceeded statutory authority, were arbitrary and capricious, and did not follow required procedure. It barred specified future suspension of plaintiff states’ approved plans and withholding of their NEVI funds except as Congress and applicable rules authorize.
March 12, 2026 FHWA implemented a provision of the FY2026 DOT appropriations law. The law repurposed $503,756,000 in previously distributed NEVI balances for highway infrastructure programs. The amount removed from availability varied by state.

Did the court restore federal EV charging funds?

The January 2026 judgment found the administration’s February 2025 suspension actions unlawful, but its protections have a defined scope: they address plaintiff states and do not override requirements Congress and applicable rules authorize. The court record said FHWA’s August 2025 Interim Final Guidance remained in effect; it reported that no further guidance had been published and that agency counsel represented FHWA did not intend to update the interim guidance.

California’s Department of Justice announced that $379 million in California NEVI funding became accessible after the final ruling. That is the state’s account of the effect for California, not a figure for all states. Separately, the March 2026 appropriations implementation reduced the availability of some previously distributed balances. The court ruling and the later congressional funding change therefore both affect the program’s status.

How much NEVI money did Tesla get?

A nationwide Tesla total is not established by the cited state awards. A documented example comes from Washington: the Washington State Department of Transportation (WSDOT) named Tesla among five companies selected in its January 2026 award announcement. WSDOT’s grant page lists two proposed Tesla site awards:

These are proposed awards in Washington, not evidence of Tesla’s national NEVI receipts, completed contracts, or operating stations. WSDOT notes that an award announcement does not make a contract effective until it is signed. Washington Secretary of Transportation Julie Meredith said the projects “fill key gaps in the state’s highway EV charging network and will make electric vehicle travel even more convenient.”

What NEVI-funded stations are meant to provide

NEVI supports public DC fast-charging infrastructure. Washington’s published requirements call for at least four 150 kW CCS connectors and 600 kW of total station power per funded station. Those specifications describe the state’s requirements, not a guarantee that every funded site is already built or open to drivers. An award, a signed contract, construction, and an operating charging station are different stages.

Are NEVI-funded chargers still being built?

The available program record establishes that revised interim guidance was in effect in the January 2026 court record, and that Washington announced proposed awards that month. It does not establish that every proposed award became a signed contract or that every NEVI-funded charger is under construction or operating. State project announcements and status pages are the relevant place to check a particular site’s award, contract, and construction status. Funding also depends on applicable program rules and the later statutory repurposing of balances.
