For a typical U.S. purchase from a federally licensed firearms dealer (FFL), bring acceptable identification, complete ATF Form 4473 truthfully, and let the dealer conduct the required background-check process before any transfer. That federal outline is not a state-by-state checklist: state and local rules, firearm type, and individual circumstances can add requirements or prohibit a transfer.
Before visiting the dealer
Check your state and local requirements before starting a purchase. Ask the dealer whether your jurisdiction requires a permit, a waiting period, an additional check, or other paperwork. Requirements can depend on where the sale takes place and on the firearm type; the dealer can explain its process, but you should verify applicable rules with your state authority.
Bring current government-issued identification that establishes your name, residence address, date of birth, and photograph. A valid driver’s license or state identification card commonly serves this purpose. ATF permits a combination of valid government-issued documents when, together, they provide the required information. ATF guidance on identification and unlicensed purchasers.
What happens during a typical dealer sale
- Complete Form 4473 yourself. For a covered over-the-counter sale to an unlicensed buyer, the dealer obtains ATF Form 4473 before transfer. You complete the buyer sections and certify your answers; the form must be completed, signed, and dated before delivery. Answer accurately, and do not buy for someone else as a so-called straw purchaser. ATF Form 4473 and firearms forms.
- Show identification. The dealer checks your identity using acceptable identification and completes the dealer portions of the transaction record.
- Undergo the required background-check process. The dealer contacts the FBI’s National Instant Criminal Background Check System (NICS), or an applicable state point of contact, unless a lawful exception applies. The FBI describes NICS as the system used by FFLs for these checks. FBI: About NICS.
- Wait for a lawful transfer decision. An approval does not make an otherwise unlawful transfer legal. The dealer must not transfer a firearm if the dealer knows or reasonably believes the buyer is prohibited, and the dealer may decline a sale.
Who may be prohibited under federal law
Federal prohibitions include a range of categories described by the FBI, including people convicted of specified serious crimes; fugitives from justice; unlawful users of or people addicted to controlled substances; people with certain mental-health adjudications or involuntary commitments; people unlawfully present in the United States and certain nonimmigrant-visa holders; people dishonorably discharged from the Armed Forces; people who renounced U.S. citizenship; people subject to qualifying protective orders; and people convicted of qualifying misdemeanor domestic-violence crimes. This list is only an overview, not a personal eligibility determination. Statutory details and exceptions matter, and state law may impose additional restrictions. If you are uncertain whether a legal circumstance affects your eligibility, resolve that question with a qualified legal professional before attempting a purchase. Do not rely on a background-check result to override a prohibition that applies to you.
What a delayed or denied background check means
Delayed
A delay means more research is needed; it is not a final denial or an approval. The FBI explains: “A ‘Delayed’ message means the FBI needs to do additional research to verify the person’s background.” Under the federal default, an FFL may be able to transfer after three business days without a determination if state law does not prohibit it, but the dealer is not required to do so. The current Form 4473 notice also describes an extended 10-business-day timeline in specified cases involving a potentially disqualifying juvenile record and a buyer under 21. State requirements, dealer policy, and current governing rules affect the outcome, so do not assume a sale will be completed on a fixed schedule. FBI: About NICS; current ATF Form 4473 and notices.

Denied
A denial may result from a state or federal prohibition. The FBI directs denied individuals to its challenge process and Voluntary Appeal File options. Use the FBI’s guidance to understand available steps: FBI: About NICS.
Buying from a dealer while outside your state of residence
For a nonresident, the usual ATF-described route is for the selling dealer to ship the firearm to an FFL in the buyer’s state of residence. The receiving dealer then handles Form 4473 and the background check before handing over the firearm. A dealer may sell a rifle or shotgun directly over the counter to a nonresident only when federal law and the laws of both states permit the transaction. That limited long-gun route should not be generalized to handguns, frames, or receivers. Check with both dealers and the relevant state authorities before arranging an interstate transaction. What to confirm for your own purchase
- Which state and local rules apply at the place of sale and, where relevant, the receiving dealer.
- Whether your jurisdiction requires a permit, waiting period, additional background check, or other documentation.
- Which identification documents the dealer will accept.
- Whether the firearm type and your state of residence affect where the transfer may occur.
- How the dealer handles a delayed check and what current law allows in your circumstances.
The FBI reports that NICS has conducted more than 500 million background checks since the system launched in 1998 and issued more than two million denials; the cited overview does not specify a publication date for those cumulative figures.
