If a firearm background check is delayed, it is still under review—not a final denial. If it is denied, ask the dealer for the transaction number and the denying agency’s details, then request the reason from the FBI or the relevant state agency. In either case, first find out which agency handled the check: state procedures and waiting periods can change what happens next.
This is general U.S. federal guidance for a retail firearm purchase. State law, the agency conducting the check, and the purchaser’s age can affect the process and transfer timing.
Start by confirming the check’s status and who handled it
Ask the dealer whether the response is delayed or denied, and whether the FBI or a state point of contact handled the check. If the dealer has it, get the NICS or state transaction number. For a denial, ask for the denying agency’s name and address as well. These details help you contact the right office; a dealer may not know the specific reason for a denial.
- Delayed: The check needs more research because information supplied for the check matched potentially prohibiting records. The match still needs to be resolved; the status is not a final determination that you are prohibited from receiving or possessing a firearm. The FBI explains its process on its About NICS page.
- Denied: The check returned a match to information indicating a legal prohibition. A mistaken identity or an incomplete or inaccurate record may be involved, so get the reason before drawing conclusions about what the record says.
If the check is delayed
Ask the dealer which agency is reviewing the check and whether anything further is needed from you. The FBI says it continues working to resolve delayed cases. Wait for the status to change rather than treating a delay as a denial.

The FBI’s denial-reason request and denial-challenge procedures are not available while an FBI check remains in delayed status. If the dealer says the check is still delayed, ask how the dealer will handle the transfer if it remains unresolved and verify any state waiting-period requirements. A possible transfer after the federal waiting period is not the same as a “proceed” response.
Can you pick up the firearm after three business days?
Not necessarily. Under the federal baseline, if NICS has not issued a proceed response, the transfer is generally barred during the initial three-business-day period. If no denial has been issued by the end of that period, federal law may allow the dealer to transfer the firearm in circumstances covered by the rule. The dealer is not required to do so, and state law may require a longer wait or other conditions. ATF says dealers must follow applicable state waiting periods even when federal NICS requirements are satisfied.

The check-initiation day is not counted. For this rule, a business day is a day on which state offices are open. ATF’s regulation gives this example: if a dealer contacts NICS on Thursday and state offices are closed on weekends, the three business days elapse on Tuesday, so a transfer may occur Wednesday, subject to the rule’s terms. That example is not a universal calendar calculation; state holidays and the details of a particular transaction can matter.
The regulation also has a separate process for some purchasers under 21. Do not assume that the general three-business-day rule applies in the same way to every purchaser. Check the current rule and ask the dealer which timing requirements apply to your transaction.

If the check is denied
Request the reason
Ask the dealer for the transaction number and the name and address of the agency that issued the denial. ATF’s Firearms Questions and Answers, last updated January 15, 2026, says the dealer should provide this information along with applicable FBI or state appeal information. You may request the specific reason in writing from the FBI NICS Section or the relevant state point of contact. FBI guidance says a reason request identifies the prohibiting category and does not require fingerprints or supporting documents.
A denial does not, by itself, tell you whether the match involved mistaken identity, an inaccurate record, or another issue. The reason can help identify which route is relevant. For example, a check may match a prohibiting record even if the person has never been arrested: the FBI explains that NICS uses names and other identifying descriptors and considers prohibitions that do not necessarily require an arrest or conviction.

Challenge an FBI NICS denial when appropriate
If the FBI handled the check and you believe the denial is wrong, follow the FBI’s Challenges / Appeals process. You can submit a challenge and relevant records, such as evidence that rights were restored. The FBI says it will respond within 60 calendar days with a final status or advise that the request remains unresolved. This is the FBI’s stated response period, not a guarantee that every underlying record will be corrected within that time.
If the underlying information is held by another agency and is wrong or incomplete, you may also need to contact that record-holding agency to seek a correction. The FBI challenge process applies to denied checks, not to an FBI check that is still delayed. If a state point of contact handled the check, ask that agency for its denial-review process rather than assuming the FBI procedure applies.

Consider the FBI Voluntary Appeal File for recurring identity matches
The FBI’s Voluntary Appeal File (VAF) is an optional longer-term route for people who believe they may legally receive and possess firearms and repeatedly encounter identity-related denials or long delays. The FBI describes it as potentially useful when an underlying record cannot readily be changed or when fingerprints have previously helped clarify identity. A VAF entry is not a substitute for resolving a specific denial or correcting a record when correction is needed.
Find the right state or federal contact
State procedures differ, including which agency conducts the check. ATF’s Brady State Lists, last updated February 10, 2026, identifies state point-of-contact arrangements and state-specific notes. Use the list to help identify the relevant agency, then confirm current requirements with that agency and the dealer. The governing rules are those that apply where the transfer would take place.
